8-1-1: ENCROACHMENTS; DEPOSIT OF GARBAGE AND REFUSE:
   A.   Encroachments:
      1.   Definitions: As used in this subsection, the following words and terms shall have the meanings ascribed to them as follows:
    ENCROACHMENT: Any building, fence, sign, or any other structure or object of any kind (with the exception of utilities and public road signs) which is placed, located or maintained in, under or over any portion of the roadway right of way.
   ROADWAY RIGHT OF WAY: Those areas existing or acquired by dedication or by fee simple for highway purposes; the easement is in effect.
      2.   Encroachments Prohibited: It shall be unlawful for any person, firm or corporation to erect or cause to be erected, to retain or cause to be retained, an "encroachment", as defined in subsection A1 of this section, within the limits of a "roadway right of way", as defined in subsection A1 of this section, within the village.    B.   Deposit Of Garbage, Refuse, Snow, Landscape Waste, Junk Vehicles, Etc.: It shall be unlawful for any person, firm or corporation to dump or deposit, or cause to be dumped or deposited, any garbage or refuse, ice or snow, grass, leaves, branches, junked materials, vehicle bodies, dirt, stone, ashes, wood, or any other objectionable substance upon the public streets, sidewalks, alleys, roadways, or gutters of any public street or public sidewalk, or upon any public property of the village, except at dump sites set aside for such purposes, unless such person, firm, or corporation shall first apply for and obtain a permit from the village to so dump and deposit said materials; except, that leaves may be deposited in the gutters of streets adjacent to the property owned or occupied by the person depositing the same if said leaves are deposited with the intent of immediately burning the same in compliance with the terms and provisions of title 5, chapter 5 of this code.
