The maintenance of any septic tank, cesspool or house drain within 400 feet of any public well or source of water supply unless the same be of water tight construction and unless the effluent therefrom be conducted by water tight pipes to a point of at least 400 feet from such source of public water supply and the maintenance of any garbage pile or pit, manure pile or pit or pool or pond of stagnant water within 400 feet of any source of public water supply, shall be conclusively presumed to be a violation of Section 1349.06 and each day and the same is declared to be a public nuisance subject to be abated as provided by law.
