Except as otherwise provided in Iowa Code section 216.15, subsection 8, and section 216.16, subsection 6, costs including attorney fees shall be allowed as of course to the prevailing party unless the court otherwise directs. In any administrative or court proceeding which is brought by the commission under Iowa Code section 216.17, subsection 3 against the respondent in connection with the final agency action, or enforcement thereof, the court shall award reasonable administrative costs incurred by the commission in connection with such administrative proceeding, and reasonable litigation costs incurred in connection with such court enforcement proceeding. An award under this section shall be made only for reasonable litigation and administrative costs which are allocable to the commission and not to any other party. (Ord. 14-15, 12-16-2014)
