2-10-4: AMENDMENTS TO CODE:
   A.   In all instances, the Mason City Human Rights Code, or commission shall be substituted in place of all mention of the Iowa State Civil Rights Code, and/or commission with the exception of section 216.19.
   B.   In all instances, the Mayor and City Council of the City of Mason City shall be substituted in place of all mention to the Governor and General Assembly or Senate of the State of Iowa.
   C.   In all instances, the City of Mason City shall be substituted in place of all mention to the State of Iowa.
   D.   Section 216.3 Commission Appointed and section 216.4 Compensation and Expenses, shall be and the same are hereby repealed in their entirety and the following is adopted in lieu thereof as provisions of the Mason City Human Rights Code: (Ord. 14-15, 2-16-2014)
Human Rights Commission: There is hereby established, under section 216.19, in the City of Mason City, Iowa, a commission to be known as the Human Rights Commission, which shall consist of three (3) members from various racial, religious, cultural and economic groups in the City.
Members of said commission shall be appointed by the Mayor, with the consent of the commission, subject to the approval of the City Council for a term of two (2) years, with the term of office expiring on January 1. Vacancies resulting in an unexpired term on the commission shall be filled by appointment by the Mayor, subject to the approval of the City Council, for the unexpired term. Any Commissioner may be removed from office by the Mayor for cause.
The commission will elect a Chairperson and Vice Chairperson from its membership. A quorum shall consist of two (2) Commissioners. The commission shall adopt, amend or rescind rules as necessary for the conduct of its meetings and proceedings.
   E.   Section 216.6.6.a Unfair Employment Practices should be and the same is hereby amended as to read:
Any employer who regularly employs two (2) or more individuals. For purposes of this subsection, individuals who are members of the employer's family shall not be counted as employees.
   F.   Any other section of the Mason City Human Rights Code notwithstanding, any complaint filed with, or under the jurisdiction of, the Mason City Human Rights Commission, shall be referred to the Iowa Civil Rights Commission for all proceedings and dispositions specified by the Mason City Human Rights Code and the Iowa Civil Rights Code.
