1-10-13: CONTRACT AWARD:
   A.   Bid Tabulation: The City Engineer, or designee, shall submit a bid tabulation to the City Council at a public City Council meeting which will include a brief description of any defects or irregularities. The City Council thereafter may waive any and all such immaterial defects or irregularities upon determining such waiver to be in the best interest of the City. The City Council shall reserve the right to reject any and all general bids if it determined that the low bidder, or their subcontractors, are not competent to perform the work as specified in the contract, and may reject any and all bids received, fix a new date for receiving bids and order publication of a new notice to bidders.
   B.   Notice Of Award: Should the City Council award the contract, the City Clerk shall give the successful bidder an official notice of award within thirty (30) days of the opening of the bids. Within fifteen (15) days after receipt of the notice of award of contract, the successful bidder shall execute at least three (3) counterparts of the agreement and provide the City Clerk with a performance payment bond as required by Iowa Code chapter 573, and such other contract documents as required by the project manual. Failure on the part of the successful bidder to fully comply with the foregoing submissions within twenty (20) days of receiving notice shall be considered just cause for voiding the agreement and the bidder forfeiting its bid bond.
   C.   Disclosure Of Subcontractors: A bidder awarded a construction contract with the City shall disclose the names of all subcontractors, who will work on the project being bid, within forty eight (48) hours after the approval of the contract. If a subcontractor named by a bidder awarded a City construction contract is replaced, or if the cost of work to be done by a subcontractor is reduced, the bidder shall disclose the name of the new subcontractor or the amount of the reduced cost.
