1-10-12: REJECTION OF BIDS:
General bids shall be for the complete work as outlined in the plans and specifications. Every general bid shall be on the form supplied by the City. No general bid shall be rejected because the bidder failed to submit prices for, or information related to, any item or items for which no specific space is provided on the form or which contains minor numerical errors. A bid containing minor immaterial defects or minor irregularities shall be accepted and read under advisement; provided, however, that the reading of a bid, or the reading of a bid under advisement, shall not operate as a waiver of any immaterial defects or deficiencies in the bid. Bids that materially vary from the project specifications shall be rejected for any of the following reasons:
   A.   If the bid is on a form other than that which is found in the project manual, as if the form is altered or any part thereof is detached.
   B.   If there are unauthorized additions, conditional or alternate bids, or irregularities of any kind which make the bid incomplete, indefinite or ambiguous as to its meaning.
   C.   If the bidder adds any unauthorized provisions in the bid reserving the bidder a right to accept or reject an award of the contract, or adds any provision giving the bidder a right to not enter into a contract with the City after approval of award.
   D.   If the bid does not contain a unit price for each pay item listed in the bid form, except in the case of authorized alternate pay items or if any unit prices are obviously unbalanced, either in excess of or below the reasonable market analysis values.
   E.   If the bidder knowingly submits false, misleading or deceptive data or information with its bid proposal or commits the same for its subcontractors. (Ord. 08-15, 11-4-2008)
