1-10-9: CONTRACT LETTING PROCEDURE:
When the estimated total cost to the City of a public improvement exceeds the sum of one hundred thousand dollars ($100,000.00), or the adjusted competitive bid threshold established in Iowa Code section 314.1B, the Public Services Director, or designee, shall advertise for sealed bids for the proposed improvement by posting a notice to bidders as provided in Iowa Code section 362.3, except that the notice to bidders may be posted not less than thirteen (13) days and not more than forty five (45) days before the date for filing bids. When the cost of a public improvement is less than one hundred thousand dollars ($100,000.00), or the adjusted competitive bid threshold established in Iowa Code section 314.1B, the Public Services Director, or designee, will not be compelled to advertise for sealed bids, but shall solicit, on an equal basis, sealed quotations from three (3) or more bidders, including targeted small businesses. Notwithstanding the foregoing, this section shall not apply to contracts for emergency repairs to public improvements; provided, however, that such emergency repairs shall be made with such competition as is practicable under the circumstances. A written determination of the basis for the emergency and for the selection of the particular contractor shall be included in the contract file. (Ord. 94-3, 2-15-1994; amd. 2017 Code)
