9-10-22: ADMINISTRATIVE REVIEW PANEL; PROCEDURE:
   A.   An administrative review panel comprised of a Police Department Supervisor, the City Clerk or the City Clerk's designee, and one (1) other City employee designated by the City Administrator shall meet as needed to review written requests for administrative review. The panel shall rule on all requests within thirty (30) days of the date the request was filed. The review shall be based on the written reasons stated in the request. A notice of fine shall be voided by the panel if it finds the parking laws of the City or the State have been erroneously applied and may be voided upon a finding of exigent circumstances which should excuse a violation of the parking laws of the City.
   B.   Persons requesting administrative review shall promptly be notified by ordinary mail of the action of the administrative review panel. If the panel determines the notice of fine should be voided, such action shall be promptly taken by the Parking Enforcement Bureau. If the notice of fine is upheld, the owner or operator shall be notified of a certain date before which the violation may be admitted by payment of the fine provided if paid before thirty (30) days. The date shall allow a period of at least thirty (30) days from the date of the notice of fine, not including the period provided for administrative review, and shall in no case be less than fourteen (14) days from the date of mailing of the notice. The said notice shall also inform the owner or operator of his or her right to continue to deny the parking violation by requesting a date upon which to appear and enter a plea before the Traffic Division of the Iowa District Court for Cerro Gordo County in the same manner as if the administrative review had not occurred.
