6-2-37: PUBLIC NOTIFICATION OF SIGNIFICANT NONCOMPLIANCE:
The City shall annually publish, in the largest daily newspaper published in the Mason City community, a list of users which, at any time during the previous twelve (12) months, were in significant noncompliance. Instances of SNC are user violations which meet one (1) or more of the following criteria:
   A.   Violations Of Wastewater Discharge Limits:
      1.   Chronic Violations: Sixty six percent (66%) or more of the measurements exceed the same daily maximum limit or the same average limit in a six (6) month period (any magnitude of exceedance).
      2.   Technical Review Criteria (TRC) Violations: Thirty three percent (33%) or more of the measurements exceed the same daily maximum limit or the same average limit by more than the TRC in a six (6) month period.
There are two (2) groups of TRCs:
 
Group I for conventional pollutants (BOD, TSS, fats, oil, and grease, etc.)
TRC = 1.4
Group II for all other pollutants
TRC = 1.2
 
      3.   Endangering Health: Any other violation(s) of an effluent limit (average or daily maximum) that the control authority believes has caused, alone or in combination with other discharges, interference (e.g., slug loads) or pass-through; or endangered the health of the sewage treatment personnel or the public.
      4.   Exercise Of Emergency Authority: Any discharge of a pollutant that has caused imminent endangerment to human health/welfare or to the environment and has resulted in the POTW's exercise of its emergency authority to halt or prevent such a discharge.
      5.   Failure To Meet Compliance: Failure to meet, within ninety (90) days after the schedule data, a compliance schedule milestone contained in a local control mechanism or enforcement or for starting construction, completing construction or attaining final compliance.
      6.   Failure To Provide Reports: Failure to provide, within thirty (30) days after the due date, required reports such as baseline monitoring reports, ninety (90) day compliance reports, periodic self-monitoring reports and reports on compliance with compliance schedule.
      7.   Noncompliance Report: Failure to accurately report noncompliance.
      8.   Other Violations: Any other violation or group of violations which the control authority determines will adversely affect the operation or implementation of the pretreatment program.
   B.   Significant Noncompliance: When a user is in SNC, the Superintendent is directed to:
      1.   Report the information to IDNR as part of the annual pretreatment performance summary of permitted user noncompliance;
      2.   Include the user in the annual public notification as described above;
      3.   Address SNC through appropriate enforcement actions or document in a timely manner the reasons for withholding enforcement. (Ord. 94-14, 7-5-1994)
