(A) Any person, firm or corporation who violates any provision of this chapter for which another penalty is not specifically provided shall, upon conviction, be subject to a fine not less than $25, nor exceeding $500. A separate offense shall be deemed committed upon each day during which a violation occurs or continues.
(B) Any person, firm or corporation violating any provision of § 51.002 of this chapter shall be fined not less than $25, nor more than $500, for each offense and a separate offense shall be deemed to have been committed on each day during or on which a violation occurs or continues.
(C) Any person violating the provisions of § 51.003 of this chapter shall be subject to a fine of up to $100 for each violation.
(D) (1) Any person, firm, corporation or entity that shall violate the provisions of §§ 51.040 through 51.048 of this chapter shall upon conviction thereof be fined in an amount not exceeding $500 for each violation and a separate violation shall be deemed to have been committed on each day during or on which a violation occurs or continues. Except violations of § 51.043(E) of this chapter involving a builder who fails to obtain a construction meter and the property contains sod, there will be a minimum fine of $1,000 imposed. Any person violating any provisions of §§ 51.040 through 51.048 of this chapter shall become liable to the city of any expense, loss or damage by the city due to such violation. However, aforesaid expenses are not an exclusive list all of the expenses the city may charge, but the aforesaid fees will be automatically added to the respective property’s water bill. The penalty imposing a fine of not less than $500 shall be imposed to a property owner, agent or occupant who has continued water service in violation of § 51.047(C) of this chapter, which makes it unlawful for the water service bill to be in the name of anyone other than the current tenant(s) or owner(s) of the premises. The city may take legal action against any person, firm, corporation or entity that violates the provisions of §§ 51.040 through 51.048 of this chapter in the local municipal court and/or the Circuit Court of the county.
(2) In the event of removal or necessary repair of water meters or the remote reading system due to a broken meter seal or a cut cable to the outside meter reader or similar action, a penalty fee of $250 to $500, plus any necessary costs for repairs or replacement of the meter, meter parts or remote meter reading equipment, shall be added to the first monthly bill becoming due and payable after the detection of damage to any of the above noted equipment.
(E) Any person, corporation or organization of any kind violating the provisions of § 51.081 of this chapter, or of any special permit obtained under § 51.081 of this chapter, shall be fined not less than $25, nor more than $750, for each offense. Each day or violation and each violating location shall be considered a separate offense under § 51.081 of this chapter.
