A "swimming pool", within the meaning of this chapter, shall be any depression in the ground, either temporary or permanent, or a container of water, either temporary or permanent, and either above or below the ground, in which water of more than twenty four inches (24") (60.96 centimeters) in depth is contained and which is used primarily for the purpose of bathing and swimming. It shall be unlawful for any person to construct, install, enlarge, or alter any swimming pool unless a building permit has first been obtained from the code enforcement officer. The permit fee shall be as provided in section 11-3-8 of this code. (Ord. 1341, 5-16-1990; amd. Ord. 1450, 7-20-1992; 2013 Code)
