SECTION 4. DEPARTMENT OF WELFARE; MAYOR AS EX-OFFICIO DIRECTOR.
   (Repealed November 5, 1996)
SECTION 5. HEALTH BOARD; MEMBERS.
   The Director of Safety and the Superintendent of Schools of the City of Maple Heights District shall constitute the Health Board of the City. The Health Board may, with the approval of Council, contract with the County Board of Health or combine with other health districts to take care of any or all health activities.

SECTION 6. PROCEDURE IF SUPERINTENDENT DISQUALIFIES.
   If the Superintendent of Schools for any reason cannot or fails to qualify as a member of the Health Board, a member shall be appointed by the Mayor.

ARTICLE IX
Department of Law
SECTION 1. QUALIFICATIONS OF DIRECTOR AND ASSISTANT PROSECUTOR.
   The Director of Law shall be an attorney admitted to practice in the State of Ohio and shall have been engaged in the active, full-time practice of law for a period of five (5) years or more, next preceding the appointment.
   The Assistant Prosecutor shall be an attorney admitted to practice in the State of Ohio and shall have been engaged in the active, full-time practice of law for a period of five (5) years or more, next preceding the appointment.

SECTION 2. DUTIES OF DIRECTOR.
   The Director of Law shall act as the legal advisor to, and attorney and counsel for, the Municipality and for all officers in matters relating to their official duties. He or she shall prepare all contracts, bonds and other instruments in writing in which the Municipality is concerned and shall endorse on each his or her approval of the form and correctness thereof, and no contract with such Municipality shall take effect until the approval of the Director of Law is endorsed thereon. The Director of Law shall be the prosecuting attorney in any court of the Municipality and shall perform such other duties as may be required and provided by the Council. The Director of Law shall be the prosecuting attorney of the Municipal Court. The Director of Law may designate an assistant prosecutor with the approval of Council who shall be an attorney admitted to practice in the State of Ohio and shall have been engaged in the active, full-time practice of law for a period of five (5) years or more preceding the appointment.
