SECTION 20. LIMITATION ON TAXATION.
   (a)   The power of Council to levy taxes shall be subjected to the limitations now and hereafter provided by the Constitution and the general laws of the State of Ohio, and nothing contained in this Charter shall be construed as authorizing the levy of any taxes in excess of such limitations without the vote of the people.
   (b)   When the taxable income of a resident of the Municipality is subject to a municipal income tax in another municipality on the same income taxable by the Municipality, Council shall make provision for granting the resident a credit of the amount of income tax paid on such taxable income to such other municipality equal to One Hundred Percent (100%) of the amount obtained by multiplying the lower of the tax rate of such other municipality or of the municipality by the taxable income earned in or attributed to the municipality of employment or business activity. Council may not decrease or increase the amount of such credit without having obtained the approval for such decrease or increase by a majority of the electors of the Municipality voting on the question at a general election.

ARTICLE VIII
Departments
SECTION 1. ESTABLISHED.
   The following departments are herein established by this Charter: Department of Service, Department of Safety, Department of Law and Department of Finance; and the Council shall, by ordinance, provide for the organization thereof. Council shall have the power to establish, by ordinance, additional departments as the public necessity may require. All appointments in the several departments shall be made by the respective department directors.

SECTION 2. DUTIES OF DIRECTOR OF SERVICE AND BUILDING COMMISSIONER.
   The Director of Service shall have charge of the construction and maintenance of all public works such as repairs to and cleaning of streets, sidewalks, alleys, bridges, etc.; of sewers, drains, ditches, culverts, maintenance and cleaning of water lines; cutting of weeds; maintenance of all City buildings and property. The Director of Service shall have charge of the collection and disposal of garbage and rubbish and shall perform such other duties as may be assigned from time to time by Council.
   The Building Commissioner, appointed by the Mayor, shall approve all plans for buildings, houses, garages, etc., before issuing a permit, and shall have charge of inspection of all buildings, houses, garages, etc., under construction, and see that all conditions of the Building Code are complied with.

SECTION 3. DEPARTMENT OF SAFETY; DIVISIONS OF POLICE AND FIRE.
   The Department of Safety shall be under the direct charge of the Mayor, who shall be the Director of Safety.
   The Department of Safety shall consist of a Division of Police and a Division of Fire. The Safety Director shall make all necessary rules and regulations for the government of these Divisions and shall be charged with the duty of enforcing within the limits of the City all police, sanitary and safety regulations that are prescribed by ordinance or by the general laws of the State. Each division shall be composed of such officers and employees as may be provided by ordinance or resolution of the Council, unless otherwise provided for in this Charter. The Safety Director shall keep a detailed and complete record of all activities of these Divisions, and shall cause each employee of the Department to make report of his or her activities.
   The Director of Safety shall have the authority to suspend any employee of this Department for incompetency, gross neglect of duty, gross immorality, drunkenness, failure to obey orders given by the proper authorities, or for any just and reasonable cause. Any employee may appeal from such decision to the Civil Service Commission. In such event the Mayor shall forthwith transmit a copy of the charges and proceedings and the Commission shall hear such appeal and may affirm, disaffirm or modify the judgment, and its judgment in the matter shall be final.

SECTION 4. DEPARTMENT OF WELFARE; MAYOR AS EX-OFFICIO DIRECTOR.
   (Repealed November 5, 1996)
SECTION 5. HEALTH BOARD; MEMBERS.
   The Director of Safety and the Superintendent of Schools of the City of Maple Heights District shall constitute the Health Board of the City. The Health Board may, with the approval of Council, contract with the County Board of Health or combine with other health districts to take care of any or all health activities.

SECTION 6. PROCEDURE IF SUPERINTENDENT DISQUALIFIES.
   If the Superintendent of Schools for any reason cannot or fails to qualify as a member of the Health Board, a member shall be appointed by the Mayor.
