PREAMBLE
   We, the people of the City of Maple Heights, in the County of Cuyahoga and State of Ohio, desiring to avail ourselves of the full privileges of self-government available to us under the Constitution of this State, do hereby adopt this Charter for government of the City of Maple Heights.
ARTICLE I
Name and Boundaries
   The municipal corporation now existing and known as the City of Maple Heights shall continue to be a body politic and corporate under the same name and with the same boundaries, with power and authority to change its boundaries and annex other territory contiguous thereto in the manner authorized by the general laws of Ohio, but no territory shall be detached therefrom, nor shall the City be annexed to any other body politic, without the consent of a majority of its electors voting on such question. Such question shall be submitted to the electors at a regular election in such manner as the Council shall, by resolution or ordinance, prescribe.
ARTICLE II
Powers
   The City of Maple Heights shall have all powers now or hereafter granted to municipalities by the Constitution and laws of Ohio, and all such powers shall be exercised in the manner prescribed by this Charter, and if not prescribed herein, in accordance with the ordinances of the City of Maple Heights, and if not provided for therein, then in the manner provided by the statutes of the State of Ohio, or as may be otherwise provided by law.

ARTICLE III
Elective Officers
SECTION 1. QUALIFICATIONS.
   All elective officers shall be qualified electors and residents of the City of Maple Heights, and each member of the Council shall be a resident of the district from which elected. The Mayor and the President of Council shall be elected at large, and the members of the Council from their respective districts. The Mayor and the President of Council shall be qualified electors of the City and shall have resided in the City continuously for a period of at least three (3) years immediately preceding their election, and shall continue to be qualified electors and residents during their terms. Each member of Council shall be a qualified elector of the City, shall have resided continuously in the City for not less than two (2) years next preceding the Councilperson's election, shall have resided continually in the district from which the Councilperson seeks election, for not less than two (2) years next preceding election, and shall continue to be a qualified elector and resident therein during the term of office.

SECTION 2. TERM.
   (a)   The term of office for the successful candidate for Mayor in the Municipal election held in November of 2011 shall commence on the first day of January, 2012, following the regular Municipal election and certification by the Cuyahoga County Board of Elections, and expire on the last day of December, 2015. The successful candidate for Mayor shall serve, unless removed or the office declared vacant, until a successor is elected and qualified by certification of the Cuyahoga County Board of Elections as the successful candidate for Mayor.
Thereafter, the term for Mayor shall be four (4) years and such term shall commence on the first day in January following the regular Municipal election and certification by the Cuyahoga County Board of Elections and expire on the last day of December of the four year term. A Mayor in office shall continue to serve until a successor is elected and qualified by certification, unless the Mayor is removed or the office declared vacant.
   (b)   The terms of the Council President and all elected District Council members who are the successful candidates in the Municipal election held November of 2017 shall be for four (4) years, which terms shall commence on the first day of January, 2018 following the regular Municipal election and certification by the Cuyahoga County Board of Elections, and expire on the last day of December, 2021, with Districts Two (2), Four (4) and Six (6) serving an initial term of two (2) years.
Thereafter, the terms of all elected District Council members shall be for four (4) years, which terms shall commence on the first day of January following the regular Municipal election and certification by the Cuyahoga County Board of Elections, and expire on the last day of December of the four (4) year term. The Council President and District Council Members in office shall continue to serve until their successor is elected and qualified by certification, unless the Council Member is removed or the office declared vacant.

SECTION 3. ABSENCES; FORFEITURE OF OFFICE.
   If any elective officer shall be absent from the duties of office for a period of three (3) months or shall cease to possess any or all of the qualifications provided for in this Charter, the office shall be deemed vacant and forfeited, such forfeiture to be effective only when declared so by the Council or proper judicial authority. Each officer, however, shall serve until a successor is qualified.
