   1127.01 DEFINITIONS.
   The following definitions shall apply in the interpretation and enforcement of this chapter.
   (a)    "Subdivision" means any subdivision as defined in Ohio R.C. Chapter 711, the plat or plans of which are required to be submitted to the City or County Planning Commission for approval.
   (b)    "Health Commissioner" means the Health Commissioner of the County General Health District or his authorized representative.
   (c)    "Person" means any individual, firm, corporation, association or partnership, or other entity.
   (d)    "Plat" means a map, plan or print of a subdivision.

   1127.02 APPROVAL REQUIRED.
   No person shall commence development or construction in any subdivision, or convey lots for the purpose of construction thereon in any subdivision until a plat and other required information of such subdivision has been submitted to the Health Commissioner of the County General Health District and the subdivision approved in accordance with the requirements of this chapter; provided, however, this regulation shall not apply to any subdivision where public sanitary sewers and a public water supply have been installed and made available to each lot within such subdivision, or to any subdivision where plans for such public sanitary sewers or public water supply have been approved by the Ohio Department of Health.

   1127.03 CONTENTS OF PLAT.
   (a)    The subdivision plat shall be accompanied by a "statement of information" on a form prescribed and furnished by the Health Commissioner and containing all the information required by such form, and also accompanied by such test results as are required by the Subdivision Code.
   (b)    The subdivision plat shall show:
      (1)   The exact location of the subdivision, the boundaries, lot sizes, topographic map, watercourses, storm sewers and other details required for an intelligent review of a subdivision plat.
      (2)   Existing and proposed water mains.
      (3)   Existing and proposed sanitary sewers, storm sewers, and private sewage treatment discharge sewers.
      (4)   Detail of typical lot, showing general location of proposed home, driveway, well, cistern, septic tank, aerobic sewage treatment devices, tile absorption areas or sub-surface filters and discharge piping, downspout piping, footer tile drainage, yard and area drains, and all underground public utilities.

   1127.04 MINIMUM LOT DIMENSIONS AND AREAS.
   Each lot in each subdivision shall have minimum dimensions and areas as follows:
   (a)    In areas served only by a public or community sewerage system, residential, commercial or industrial lots shall not be less than sixty feet in average width nor less than 8,000 square feet in area. If the ground water, sub-soil and topographic conditions and drainage facilities are considered to be favorable by the Health Commissioner, the average width of lots may be decreased to fifty feet.
   (b)    In areas served only by a public or community water system, residential, commercial or industrial lots shall not be less than eighty feet in average width nor less than 12,000 square feet in area.
   (c)    In areas not served by either public or community sanitary sewer or water, residential, commercial or industrial lots shall not be less than 100 feet in average width nor less than 20,000 square feet in area.
   (d)    In the absence of a public or community sewage system, a minimum of one acre lots and 150-foot frontage may be required where the lots are within 2,000 feet of streams or major drainage courses emptying into a public water supply, if reasonably necessary to protect such water supply from contamination.
   (e)    In all areas, pie-shaped lots may be reduced to a lesser frontage; provided, however, that the required square footage is maintained and the width at the building setback line equals the required width of the area.
   (f)    In order to secure and provide the necessary area for percolations, the area requirements heretofore mentioned shall be in addition to any existing or proposed road rights of way or easements.
   (g)    Where unfavorable topographic conditions exist on any lots, building location and setback lines must be established to provide ample area to properly install a private sewage disposal system.

   1127.05 FEASIBILITY OF INDIVIDUAL WATER SUPPLIES.
   No subdivision shall be approved to install individual water supplies where the Health Commissioner determines that such individual water supplies are not feasible and could reasonably be expected to cause a public health problem. Such determination shall be based on the test results submitted as required by Section 1127.06; the details submitted on and with the subdivision plat and contained in the statement of information as required by Section 1127.03, such as proposed lot sizes, proposed size of subdivision, and topographic conditions; and on the requirements of other regulations of the County General Health District relative to the protection of individual water supplies. Where a subdivision cannot be approved to use individual water supplies, a public water supply system will be necessary.
