GENERAL PROVISIONS
(A) Codes adopted by reference. The Minnesota State Building Code, as adopted by the Commissioner of Administration pursuant to M.S. §§ 16B.59 to 16B.75, as may be amended from time to time, including all of the amendments, rules and regulations established, adopted and published from time to time by the Minnesota Commissioner of Administration, through the Building Codes and Standards Division, is hereby adopted by reference with the exception of the optional chapters, unless specifically adopted in this section. The Minnesota State Building Code is hereby incorporated in this section as if fully set out herein.
(B) Application, administration and enforcement. The application, administration, and enforcement of the code shall be in accordance with the Minnesota State Building Code. The code shall be enforced within the extraterritorial limits permitted by M.S. § 16B.62, Subdivision 1, as may be amended from time to time, when so established by this section. The code enforcement agency of this municipality is called the Department of Building Safety. This code shall be enforced by the Minnesota Certified Building Official designated by the City Council to administer the code (M.S. § 16B.65, Subdivision 1, as may be amended from time to time).
(C) Permits and fees. The issuance of permits and the collection of fees shall be as authorized in M.S. § 16B.62, Subdivision 1, as may be amended from time to time. Permits fees shall be assessed for work governed by this code in accordance with the fee schedule adopted by the City of Madison Lake in Resolution 2009-418. In addition, a Minnesota State Surcharge Fee shall be collected on all permits issued for work governed by this code in accordance with M.S. § 16B.70, as may be amended from time to time.
(D) Violations and penalties. A violation of the code is a misdemeanor (M.S. § 16B.69, as may be amended from time to time).
(E) Building Code optional chapters. The Minnesota State Building Code, established pursuant to M.S. §§ 16B.59 to 16B.75, as may be amended from time to time, allows the City of Madison Lake to adopt by reference and enforce certain optional chapters of the most current edition of the Minnesota State Building Code. The City of Madison Lake has elected against adoption and enforcement of optional chapters of the most current edition of the Minnesota State Building Code.

All construction of homes requiring sumps pumps will be hooked up to storm sewer drains constructed in the street, if available, by a certified contractor, with a minimum of 2 inches Schedule #40 PVC drain pipe, to a grade for drainage to prevent freezing, preferably 1/4 inch per foot grade. A certified statement of compliance will be signed by the contractor.
