5.44.010 Public dance hall defined.

   A public dance hall, for the purpose of this chapter, is defined to be any building, structure or tent or defined areas such as streets, sidewalks, parking lots or vacant lots of any kind or character in which dancing is allowed or permitted for the profit of the operator of such dance and to which the public generally is invited for the purpose of dancing and in which a charge is made, directly or indirectly, by the operator of such dance hall for the privilege of dancing in such building, structure, tent or defined area. 5.44.020 License-Fees-Approval.

   No person shall maintain, operate, conduct, control or manage any public dance hall in the city until such license fee as is required by law and the ordinances of the city is paid in full. Such license shall be issued by the city clerk at the rate of ten dollars per day or fifty dollars per year. No license for any public dance hall shall be granted for the maintenance, operation or conducting of any dance hall within the city without first obtaining approval from the chief of police. 5.44.030 Hours of operation.

   It is unlawful for any person operating, conducting or maintaining a public dance hall, to permit dancing in such dance hall after two hours after midnight of the date of the dance. (Ord. 371 (part), 1933: prior code § 7-3-16 (part))

5.44.040 Officer of law to be present.

   A.   It shall further be unlawful for any person operating or maintaining a public dance hall to permit dancing at any time without a uniformed policeman or duly commissioned officer of the law wearing distinctive forms of dress approved by the chief of police which by its appearance indicates that such person is an officer of the law and as a part of said uniform, the officer will at all times display an official badge indicating the commission under which he works. Such officers may be on duty or off duty.

   B.   The chief of police may authorize by written authorization, persons duly licensed under the Private Investigators Act to serve in place of the duly commissioned officer of the law.

   C.   Failure to provide such uniformed policeman, duly commissioned officer of the law, or person duly licensed under the Private Investigators Act with approval from the chief of police, shall be grounds for revocation of license. (Ord. 331,1984: prior code § 7-3-16 (part))
