376.01   Definitions.

376.01 DEFINITIONS.
   As used in this chapter:
   (a)   “Low-speed micromobility device" (LSMD) is defined as a manually operated or manually steered device weighing less than one hundred pounds that is propelled by an electric motor or a combination of human and electric power, and has an attainable speed on a paved level surface of not more than twenty miles per hour when propelled by the electric motor.

   (b)    A human propelled bicycle shall not be considered a LSMD.
   (c)    "Electric-assisted bicycle" means a bicycle with two or three wheels, a saddle, fully operative pedals for human propulsion, and an electric motor. The electric-assisted bicycle's electric motor must have a power output of no more than seven hundred fifty watts. An Electric-assisted bicycle shall not be considered a LSMD.

376.02 USAGE AND RESTRICTIONS.
   No person shall operate a LSMD on public streets, highways, sidewalks, shared-use paths, or bicycle-exclusive roadways. Nothing within this chapter shall prohibit the use of any electrically-assisted bicycle as defined within this chapter and as regulated by the Ohio Department of Natural Resources (ODNR), from lawfully operating within any portion of the Little Miami Scenic Bike Trail, or any portion of the right-of-way thereof. Further, any electrically-assisted bicycle operating within ODNR right-of-way shall be exempt from enforcement of this Chapter. Notwithstanding the forgoing, persons operating electrically-assisted bicycles outside of the limits of ODNR right-of-way on any public road, street, alleyway, or rights-of-way shall be subject to the same traffic, safety and operational rules, regulations and limitations governing the use of bicycles within any public street, public alleyway, or other public right-of-way located within the City of Loveland, Ohio.
