111.02 STORMWATER, SANITATION AND ENVIRONMENT, AND WATER UTILITY SERVICES.
   (a)   Sanitation and Environment Fees and Charges.
      (1)   For bills due April 2021 and thereafter, the fee for each residential unit within the City corporation limits will be $17.71 per month and $18.81 non-residents within the Loveland utility billing area.
      (2)   For bills due April, 2021 and thereafter, multi-family units utilizing dumpsters shall be billed at the per dumpster rate set forth in Exhibit A, as attached to Resolution 2021-13. In addition, multi-family accounts shall also be responsible for a monthly environment/sanitation fee of $6.20 per unit. (Ord. 2021-15. Passed 2-9-21.)
      (3)   For bills due January, 2011, and thereafter, $5.55 per month per unit monthly environment/sanitation fee shall be applied to all commercial accounts not being charged for waste collection.

   (b)   Stormwater Fees and Charges. Council, upon recommendation of the City Manager, shall establish reasonable rates for storm water management systems for each single-family and two-family residential dwelling unit; each single-family and two-family residential dwelling unit shall be billed a flat fee established by ordinance. Equivalent residential units (ERUs) will be rounded to the nearest tenth (0.1) of a unit. The rates to be charged for the storm water use fee for equivalent residential units shall be:
      (1)   $4.25 per month per ERU starting on January 1, 2011.
      (2)   Parcels which meet the definition of vacant land pursuant to §925 of the Code of Ordinances shall be assessed a storm water user fee of $0.00.
      (3)   For all residential and nonresidential properties, that are not covered by subsections (1), and (2) hereof, the rate shall be computed based on the total impervious area of the property, divided by the established impervious area of an ERU, times the rate established for an ERU. The billing amount shall be updated by the City based on any additions to the impervious areas as approved through the building permit process. Under no circumstances shall a property owner be charged less than the then current ERU rate as established in subsection (1) hereof.

   (e)   Anyone disposing of items without permission of the City Manager or disposing of items pursuant to Codified Ordinance Section 521.08 (f) shall be subject to a fine not to exceed five hundred and 00/100 dollars ($500.00) or six (6) months in jail or both.

   (f)   Water rates for the County Water Area which is defined as the area outside of the corporate limits of the City of Loveland as set forth in that certain contract between the City of Loveland and the Board of County Commissioners of Hamilton County, Ohio dated the 18th day of August, 2012, shall reflect the following schedule of differentials in water rates between the City of Loveland and the County Water Area customers as follows:
      (1)   Through December 31, 2017 rates charged to CWA customers shall be 1.25 times the City of Loveland’s rates and thereafter as set forth in (2) below.

   (g)   Water Main Replacement (WMR) Fee.
      (1)   For bills due January 2023, and thereafter, there shall be a monthly fee of seven dollars and fifty cents ($7.50) per unit, within the Loveland Utility billing area.
      (2)   For bills due January 2024, and thereafter, the monthly fee shall increase to eight dollars and fifty cents ($8.50) per unit, within the Loveland Utility billing area.
      (3)   For bills due January 2025, and thereafter, the monthly fee shall increase to nine dollars and fifty cents ($9.50) per unit, within the Loveland Utility billing area.
      (4)   All proceeds from the WMR fee shall be deposited into a dedicated line item within the Water Capital Improvement fund and utilized for the replacement of water mains within the City’s water distribution system.
