Any person appointed as a Commissioner of an executive department during the first six (6) months following the effective date of this Charter who is covered by the classified civil service provisions of this Charter shall be appointed as an Acting Commissioner for a period not to exceed six (6) months from the date of their appointment. Any person so appointed as Acting Commissioner shall retain all of the rights and privileges to which they were entitled under the classified civil service and/or employee pension provisions of this Charter on the effective date of such appointment. If at the end of six (6) months following their appointment as Acting Commissioner, any individual covered under the provisions of this Section wishes to accept an appointment as Commissioner they shall be removed from the classified civil service in accordance with the provisions of Section 9.02 of this Charter. All matters pertaining to the pension rights of said individuals shall be resolved in accordance with the provisions of Section 9.08 of this Charter.
