(1) Definitions.
(a) Child means any person under the age of eighteen (18) years.
(b) Sex crime means a criminal conviction for a violation or attempted violation of KRS 510.040 to 510.150, 529.020 to 529.050, 529.070, 530.020, 530.065, 530.070, 531.310, 531.320 and 531.340 to 531.370. Conviction for a violation or an attempted violation of an offense committed outside Kentucky is a sex crime if such offense would have been a crime in Kentucky under one of the above-enumerated statutes.
(c) Central criminal records file check means a check of criminal records pursuant to KRS 17.160.
(d) Volunteer means any person who offers to perform his services on a regular basis, without remuneration, to any agency, club, organization or school, in any capacity which would place him in a position of supervisory or disciplinary control over children. The commissioner of public safety shall promulgate regulations, subject to approval by majority vote of the urban county council, to further define which volunteers must submit to a records check according to the terms of this section.
(e) Agency, club, organization, day care center or school includes any association which as a component of its activities or services exercises supervisory or disciplinary control over children.
(2) All agencies, organizations, clubs, day care centers or schools which receive funds from the urban county government shall perform a central criminal records file check on any prospective employee or volunteer who would be in a position to exercise disciplinary or supervisory control over children. Funding by the urban county government shall be conditional upon compliance by the agency, club, organization, day care center or school with this section. The responsibility and cost of performing the records check shall be borne by the agency, organization, club or day care center and not by the urban county government.
(3) The urban county government shall perform a central criminal records file check of all volunteers within the urban county government who would be in a position to exercise supervisory or disciplinary control over children. The commissioner of public safety shall be responsible for administering the records check program.
