§ 51.020 BURNING RESTRICTIONS; DEFINITION.

   (A)   For the purpose of §§ 51.021 through 51.025, the nighttime hours shall be defined as from one-half hour after sunset to one-half hour before sunrise.

   (B)   No open burning shall be allowed unless the City Fire Department has been notified at least 24 hours in advance of the date, time and location of the burning.

   (C)   No open burning of leaves shall be permitted.

   (D)   A person who openly burns any materials shall extinguish the fire if the fire creates a nuisance or fire hazard.

   (E)   All fires must be attended to at all times during the burning until the fires are completely extinguished and the burning shall be conducted only during daylight hours and all fires shall be extinguished prior to sunset.

   (F)   Burning may not be conducted during unfavorable meteorological conditions such as high winds, temperature inversions or air stagnation.

   (G)   No asbestos-containing, materials are permitted to be burned.

   (H)   All burning must comply with all state and federal laws and, in particular, any regulations promulgated by the Air Pollution Control Board.

§ 51.021 INTENTION OF COUNCIL; GENERALLY.

   It is the express intention of the Common Council to protect the public from the burning of rubbish within the city in two respects:

   (A)   The burning of rubbish during the nighttime, or in the dark hours of the day, as hereinafter defined, in that the same constitutes a safety hazard to vehicular traffic traveling on the streets of the city; and

   (B)   The burning of trash, as regulated in §§ 51.022 through 51.025, which may constitute a factor injurious to public health within the city limits by reason of polluting the air.

§ 51.022 BONFIRES AND OUTDOOR RUBBISH FIRES.

   (A)   Location restricted.  No person shall kindle or maintain any bonfire or rubbish fire or authorize any fire to be kindled or maintained on any private land unless:

      (1)   The location is not less than 50 feet from any structure and adequate provisions are made to prevent fire from spreading to within 50 feet of any structure; or

      (2)   The fires is contained in an approved waste burning container located safely not less than 15 feet from any structure.

   (B)   Chief may prohibit.  The Chief of the Fire Department may prohibit any or all bonfires and outdoor rubbish fires when atmospheric conditions or local circumstances make the fires hazardous.

§ 51.023 LEAVES, WEEDS AND THE LIKE.

   No person shall burn leaves, rubbish or weeds in the city during the dark hours of the day or nighttime, except that the Mayor may issue a proclamation designating a cleanup week and other times and fix hours during the days of the weeks and other times that it shall be lawful to burn leaves, rubbish or weeds.

§ 51.024 GARBAGE.

   For the purpose of this section, GARBAGE shall be defined as kitchen waste and other waste matter and vegetable matter. No garbage within the meaning of the definition of this section shall be burned at any time with in the city.
