(A) Each person who operates, conducts or maintains a school of massage, massage therapy clinic or bathhouse shall make application for an operator’s license to operate the school of massage, massage therapy clinic or bathhouse with the Clerk-Treasurer of the city on application forms prescribed by him or her. The application for a license shall contain the following information and should be individually signed by the applicant:
(1) Name of applicant;
(2) Residence address of applicant;
(3) Business address of applicant;
(4) Number of massage tables, shower stalls, bath stalls or other individual units;
(5) The age and citizenship of the applicant, in the case of individuals, and of the manager or officers in the case of a corporation;
(6) The names, addresses, ages, citizenship and designations of each person connected with the applicant’s establishments;
(7) Whether the applicant or its manager or officers have ever been previously engaged in operating a school of massage, massage therapy clinic or bathhouse;
(8) Whether any applicant, or in the case of a corporation, its manager, officers, directors or stockholders have ever been convicted of any act of violence, moral turpitude, sex offense or prior violation of this chapter;
(9) An agreement by the operator permitting inspections; and
(10) Type of license being applied for by the applicant.
(B) Along with the operator’s application for a license there should be filed a verified application for a massage therapist license by each individual who is employed in the establishment. The application should contain the following information:
(1) Name;
(2) Age;
(3) Address;
(4) Citizenship;
(5) Whether convicted of any public offense concerning an act of violence, moral turpitude, sex offense or prior violation of this chapter; and
(6) Nature of work performed.
(C) Along with the aforesaid applications for license there should be a certificate from a duly licensed medical practitioner, on a form prescribed by the Health Department of the county, certifying that the applicant is free from communicable diseases and that the examination has been made within 30 days prior to the application for the license or permit herein sought.

(A) Each person, firm, partnership, sole proprietorship or corporation who operates a massage therapy clinic or bathhouse, or any combination thereof, shall pay an annual license fee of $500 for an operator’s license. An operator’s license shall be valid for a period of 12 months from the date of its issuance and may be renewed for an additional 12-month period upon payment to the Clerk-Treasurer of $500 operators’s renewal fee provided the same is accompanied by an affidavit setting forth changes, if any, of circumstances or conditions that would affect or alter the information contained in the applicant’s application for an operator’s license and setting forth whether the applicant is abiding by the terms and provisions of this chapter.
(B) The Clerk-Treasurer shall charge and collect a semiannual fee of $100 for each masseuse and/or massage therapist license. A masseuse and/or massage therapist license shall be valid for a period of six months from the date of its issuance and may be renewed upon the payment to the Clerk-Treasurer of the $100 license fee provided the same is accompanied by a certificate from a duly licensed medical practitioner in the count, on a form prescribed by the Health Department of the county, per signed ordinance, certifying that the examination has been made within ten days prior to the application for the renewal of the license or permit.

(A) No school of massage, massage therapy clinic or bathhouse shall be operated or conducted in, or with a direct opening to living quarters. There must be a separate entrance to the living quarters, and a separate entrance to the place of business. No one should use the business quarters for a place of habitation.
(B) All licensed operators or permit holders under this chapter shall show their license or permits in a visible location in their establishment.
(C) All licensees or permit holders shall be subject to all other city ordinances, county ordinances and state statutes and to the regulations of various administrative bodies of the city, county and state and violation of the regulations, ordinances or statutes shall be grounds for revocation of licenses or permits.
(D) It shall be unlawful for any person to be employed by any licensee under this chapter or to be within view of any of the services rendered by a massage therapy clinic or bathhouse who has not reached the age of 21 years.
(E) Every school of massage, massage therapy clinic or bathhouse shall be open for inspection at all times by police officers and duly authorized representatives of the City Clerk-Treasurer upon the showing of proper credentials by those persons. It shall be unlawful to deny persons entry to the establishments.
(F) Every school of massage, massage therapy clinic or bathhouse shall be open no later than 2:00 a.m. Further, the license issued herein shall only authorize the applicant to offer services on the premises for which the license is issued and at no other place.

(A) Qualifications. The Clerk-Treasurer, before issuing any license provided for herein, shall investigate the character of the applicant and the officers, directors and manager of the business if it be a corporation. No license shall be issued if he or she shall find:
(1) Any of the persons named in the application or any employees thereof are not persons of good moral character;
(2) Any of the persons have previously been connected with any school of massage, massage parlor, massage therapy clinic or bathhouse where the license therefore has heretofore been revoked or where any of the provisions of the law applicable to schools of massage, massage therapy clinics or bathhouses have been violated; or
(3) If the premises sought to be so licensed, fail to comply in any manner with the ordinances and laws applicable thereto.
(B) All applicants for a license to engage in the practice of massage therapy must submit a certificate or affidavit of their respective qualifications as to schooling, training and experience and where and how obtained.

All complaints of alleged violations of the provisions of this chapter shall be made in writing to the Clerk-Treasurer. Upon receiving a complaint, the Clerk-Treasurer shall refer the same to the Board of Public Works and Safety, who shall conduct a hearing thereon. If the Board of Public Works and Safety should determine the license shall be revoked, and order of revocation shall issue to the Clerk-Treasurer, who shall thereupon revoke the license without refund of license or permit fee.
