(A) The Mayor is the City Executive and shall be elected for a term of four years as provided in I.C. 3-10-6.
(B) A person is eligible to be the executive only if that person has been a resident of the City for at least one year immediately preceding his or her election. The Mayor forfeits office if he or she ceases to be a resident of the City.
The Mayor shall:
(A) Enforce the ordinances of the City and the statutes of the state;
(B) Provide a statement of finances and general condition of the City to the Common Council at least once a year;
(C) Provide any information regarding City affairs that the legislative body requests;
(D) Recommend, in writing, to the Common Council actions that the Mayor considers proper;
(E) Call special meetings of the Common Council when necessary;
(F) Supervise all subordinate officers;
(G) Ensure efficient government of the City;
(H) Fill vacancies in City offices when required by I.C. 3-13-1 et seq.;
(I) Sign all bonds, deeds and contracts of the City and all licenses issued by the City;
(J) Approve or veto ordinances, orders and resolutions of the legislative body under I.C. 36-4-6-14;
(K) Make appointments prescribed by I.C. 36-4-9 and 36-4-11-2; and
(L) Perform any other duty prescribed by statute.
(A) The City Clerk is the clerk of the City and shall be elected for a term of four years as provided by I.C. 3-10-6.
(B) A person is eligible to be the City Clerk only if that person has been a resident of the City for at least one year immediately preceding his or her election. The City Clerk forfeits office if he or she ceases to be a resident of the City.
The City Clerk shall:
(A) Serve as clerk of the Common Council as prescribed by I.C. 36-4-6-9 and maintain custody of its records;
(B) Maintain all City records required by law;
(C) Keep the City Seal;
(D) As soon as a successor is elected and qualified, deliver to that successor all the records and property of the City Clerk’s Office;
(E) Perform other duties prescribed by law;
(F) Administer oaths when necessary in the discharge of the City Clerk’s duties, without charging a fee;
(G) Take depositions, without charging a fee; and
(H) Take acknowledgment of instruments that are required by statute to be acknowledged, without charging a fee.
