CHAPTER 131: OFFENSES AGAINST PUBLIC PEACE AND SAFETY

§ 131.01 DISORDERLY CONDUCT; OFFENSES ENUMERATED.
   (A)   Any person found guilty of the following offenses in the city shall be deemed a disorderly person and punished as in this code provided.
   (B)   The following offenses shall be, but are not limited to:
      (1)   Any person of sufficient ability who shall fail, refuse or neglect to support his wife and/or minor children.
      (2)   Any parent, guardian or other person having the care or charge of a minor child or children, who shall neglect, abandon or fail to care for properly; or any person who shall permit, allow or encourage a child to become a delinquent or fail to send to school a child or children of school age during all regular school days.
      (3)   Any window peeper.
      (4)   Any prowler.
      (5)   Any common prostitute.
      (6)   Any person who engages in an illegal occupation or business, directly or indirectly, or permits any other person to engage in an illegal occupation upon his premises in any place within the city; (proof or recent reputation for engaging in an illegal occupation shall be prima facie evidence of being engaged in an illegal occupation or business.)
      (7)   Any person commits the crime of loitering if he:
         (a)   Loiters, remains or wanders about in a public place for the purpose of begging;
         (b)   Loiters or remains in a public place for the purpose of gambling with cards, dice or other gambling paraphernalia;
         (c)   Loiters or remains in a public place for the purpose of engaging or soliciting another person to engage in prostitution, deviate sexual intercourse, or other sexual behavior of a deviate nature; or
         (d)   Being masked or in any manner disguised by unusual or unnatural attire, loiters, remains or congregates in a public place with other persons so masked or disguised, or knowingly permits or aids persons so masked or disguised to congregate in a public place. This division (B)(7) (d) shall not apply to the pranks of children on Halloween, to those going to and from masquerade parties, to those participating in any public parade of an educational, religious or historical character, or to those participating in the parades of minstrel troupes, circuses or other amusement or dramatic shows.

      (8)   Any person who shall loiter in or about any police station or police headquarters building, jail, hospital, court building, school, or any street, alley or other public building.
      (9)   (a)   Any person who shall be drunk or intoxicated or under the influence of narcotics or other drugs to the degree he may endanger himself or other persons, or property, or annoy persons in his vicinity, or any person engaged in indecent, immoral or obscene conduct in any public or private place, or shall expose himself indecently in any place by reason of which the public peace and good order of the neighborhood is disturbed.
         (b)   Any vagrant or beggar or person who is unable to give a satisfactory account of himself, or his actions, or is without any lawful means of support.

      (10)   Any person who shall make or assist in making any noise, disturbance, trouble or improper diversion or any rout or riot, by which the peace and good order of the city are disturbed.

      (11)   Any person found loitering in a house of ill fame or prostitution or place where prostitution or lewdness is practiced, encouraged or allowed.
      (12)   Any person who shall be found jostling or roughly crowding people unnecessarily in any public or private place.
      (13)   All persons who shall collect in a crowd or group resulting in the annoyance or inconvenience to a person or persons, or the obstruction of any street, way or passage, or shall interfere with the peaceful conduct of any lawful meeting, gathering or assembly of persons.
      (14)   Any person who shall willfully or carelessly injure or assault another or engage in any fight or quarrel, or who shall use vile, indecent, obscene, profane or threatening language in any public or private place by reason of which the peace and good order of the neighborhood is disturbed.
      (15)   Any person who shall improperly or loudly or wrongfully accost, solicit, ogle, insult, whistle, wolf call, molest, follow, pursue, lay hands on, or by gesture or movement of body, or otherwise, willfully annoy any person in any place in the city for any purpose.
      (16)   Any person having in his possession any policy slips, tip sheets, dice, cards or any device used for gambling, or other gambling paraphernalia.
      (17)   Any person having in his possession any instrument or tool commonly used for gambling, burglary, robbery or stealing; or illegal knife, razor, pistol, blackjack or other article or instrument which may be used as a dangerous weapon, or used for carrying on any illegal occupation.
      (18)   Any person who shall have in his possession, either at home, car, person or otherwise, any pistol, revolver or firearm less than 30 inches in length without the same having been registered with the Police Department.
      (19)   Any person who sells, gives, loans or furnishes another with a pistol or firearm less than 30 inches in length.
      (20)   Any person who shall have in his possession, sell or offer for sale, show or exhibit any indecent or obscene picture, engraving, drawing, book, pamphlet or other indecent printed matter, or is in possession of any drug, poison or other narcotic contrary to the state law.
      (21)   Any person who shall mark, deface or otherwise willfully or maliciously remove or damage the buildings, goods, chattels, trees, shrubs, plants or other property of another, or any public property.
      (22)   Any person resisting lawful arrest or interfering directly or indirectly with an officer making an arrest, or refusing to assist an officer upon being commanded by said officer to give assistance or refusing to disperse upon the command of an officer.

      (23)   Any person who shall seek or obtain any money or other valuable thing by any trick, fraudulent scheme, device, false pretense or by gambling or any game of chance.

      (24)   Any person who shall be found in any public place dressed in the attire of the opposite sex for the purpose of disguising himself or herself to be of the opposite sex, shall be deemed a disorderly person. However, this division (B)(24) shall not apply to the pranks of children on Halloween, to those going to and from masquerade parties, to those participating in any public parade of an educational, religious or historical character, and to those participating in the parades of minstrel troupes, circuses or other amusement or dramatic shows.

      (25)   Any person who has attained the age of majority and who shall purchase alcoholic beverages for any person or persons under the age of majority, or who shall furnish alcoholic beverages to a person or persons under the age of majority in the city, shall be deemed a disorderly person.

      (26)   Any person who shall be found drinking an alcoholic beverage in a public building, park, street or alley or other public place in the city shall be deemed a disorderly person. However, this division (B)(26) shall not apply where properly authorized by law or by special permission of the city manager.

      (27)   Any person who shall be found trespassing on the premises of another wherein he knowingly enters and remains unlawfully in a building or upon premises which are enclosed in a manner designed to exclude intruders or knowingly enters and remains unlawfully in or upon any premises.
      (28)   Any person who knowingly deposits on the land, or in a building or upon a vehicle of another, without the consent of the owner, or in any public place, any stink bomb, tear gas or other device, irritant or offensive smelling substance, with the intent to interfere with another's use of the land, building or vehicle, or any person found in possession of a noxious substance as hereinbefore defined or manufactures, sends or transports any noxious substance.
      (29)   Any person who intentionally receives stolen property, retains, conceals or disposes of stolen property knowing that it has been stolen or believing that in all likelihood it has been stolen, unless the property is received, retained or disposed of with intent to restore it to the owner.

      (30)   Any person or persons who shall make or assist in making any noise, disturbance, trouble or improper diversion or any rout or riot, by which the peace and good order of the city are disturbed.

      (31)   Any person who telephones any other person or causes any other person to be telephoned and uses any vulgar, indecent, obscene, threatening or offensive language, or suggesting any lewd or lascivious act over any telephone.

      (32)   Any person who falsely assumes or pretends to be a judge, sheriff, conservation officer, coroner, constable, police officer or member of the state police, and shall take upon himself to act as such, or to require any person to aid and assist him in any matter pertaining to the duty of a judge, sheriff, deputy sheriff, conservation officer, coroner, constable, police officer or member of the state police, or shall falsely take upon himself to act or officiate in any office or place of authority.

      (33)   Any person who shall, for money or gain, tell fortunes or predict future events, by any means whatsoever; or attempt to enable anyone to get or recover lost or stolen property; or to gain success in business, enterprise, speculation or games of chance; or to make one person dispose of property, business or valuable thing, in favor of another, based on some fortune-telling device; or to publish by card, circular, sign, newspaper or any other means whatsoever that he or she shall, or will, predict future events in any manner whatsoever.

      (34)   Any person, firm or corporation who persuades, entices, induces or attempts to persuade, entice or induce a homeowner to list or sell his property based upon the allegation that if said homeowner fails to list or sell his property through said person, firm or corporation, said homeowner will be forced to accept a lower price, at a later date, because persons of a minority group are allegedly purchasing a home, or homes, within the immediate neighborhood (such offense being known as blockbusting).

      (35)   It shall be unlawful to operate or play a compact disc player, musical instrument, radio, tape player, boom-box, or any other device, equipment or instrument that amplifies, produces or reproduces a sound from any parked or moving vehicle in such a manner as to be plainly audible at a distance of greater than ten feet from the motor vehicle.

§ 131.02 DISTURBANCE OF RELIGIOUS WORSHIP.
   Any person who, on the first day of the week or at any other time, shall willfully interrupt or disturb any assembly of people met for worship of God, within the place of such meeting or out of it, shall be guilty of disorderly conduct and shall, upon conviction, be punished as in this code is provided.

§ 131.03 DISORDERLY CONDUCT ON AND AROUND SCHOOL PROPERTY.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      (1)   PRINCIPAL. Any principal of any elementary or secondary school or the chief administrative officer of any elementary or secondary school or college.
      (2)   SCHOOL. Any pre-elementary (grades K-6), secondary (grades 7-12) school, any college or combination thereof.
   (B)   Unauthorized persons not to enter or trespass on school property. No person who is not a regularly enrolled student or parent or guardian thereof or a school official, teacher or other public or school employee shall enter or trespass upon or loiter in or upon any public, private or parochial school building or school property in the city for any reason whatever, unless such person has received written permission from the principal or other person designated by the principal to be in or upon or to remain in or upon such public, private or parochial school building or school property; provided, that such written permission need not be secured by persons engaging in or attending a school or Recreation Board authorized activity, or by persons using school playground or playground equipment after school hours or when school is not in session, unless such entry or use shall have been otherwise prohibited by a rule or regulation of the School Board, school principal or other person, board or committee with the authority to prohibit such use or entry.
   (C)   Disturbing schools. No person shall willfully or maliciously make or assist in making any noise, disturbance or improper diversion by which the peace, quietude or good order of any public, private or parochial school is disturbed.
   (D)   Duty of person creating disturbance to leave premises. Any person, whether lawfully or unlawfully in or upon any public, private or parochial school building or school property, who is found to be creating a disturbance in or upon any such school building or property, shall leave immediately when so directed by the principal or by any other person designated by the principal.
   (E)   Extortion. No person shall, by violence, threat of violence or other form of coercion, force or attempt to force any public, private or parochial school student or other person to give or to lend any money or other thing of value to any person at any time.
   (F)   Unauthorized borrowing of money or thing of value from students in the school or traveling to or from school. No person shall borrow or attempt to borrow any money or thing of value from any student in or upon any public, private or parochial school building or school property in the city or during any time when such student is engaging in, going to or returning from any regularly scheduled session or activity of any such school, without first obtaining the written approval of the principal of such school or other person designated by the principal to issue such written approval. However, this division shall not apply to college students who borrow money or things of value from other college students or adults.
   (G)   Destruction of school property. No person shall damage, destroy or deface any public, private or parochial school building or the grounds, outbuildings. fences, trees or other appurtenances or fixtures belonging thereto.

§ 131.04 PUBLIC INTOXICATION ON PUBLIC OR PARK PROPERTY.
   It shall be unlawful for any person within the city to drink intoxicating beverages or to bring intoxicating beverages on public or park property where unauthorized to do so by law.
