§ 154.038 FINAL PLAT.
   (A)   Application. Applications for final plat approval shall contain such information as may be required from time to time by the Planning Com-mission, or the City Council but in all instances shall contain the following:
      (1)   If a major subdivision, the date of preliminary plat approval and identification of any changes from such approved plat.
      (2)   The drawing. The final plat of subdivision shall be clearly and legibly drawn in black ink upon mylar at an appropriate scale from an accurate survey. It shall be drawn on one or more sheets whose maximum dimensions shall not exceed 24 § 36 inches. If more than two sheets are required, an index sheet of the same dimensions shall be filed showing the entire subdivision on one sheet and the component areas shown on the other sheet or sheets. Eight prints or copies of the final plat shall be submitted, together with two dimensionally stabilized reproducible copies. The final plat of the subdivision shall show:
         (a)   Boundary lines with accurate distances and bearings.
         (b)   Municipal, township or section lines accurately located.
         (c)   Legal description of the land embraced in the plat, showing the township and range in which such land is situated and the sections and parts of sections platted, and in the case of replatting or resubdividing, describe the part of, and the name of, the original plat which is replatted or resubdivided, containing the name of the town, village, city, or addition platted, the name of the proprietor required to sign the plat and of the surveyor making it. If there is any excepted parcel within the plat boundary, it must be accurately described by metes, bounds and courses.
         (d)   Lines of all proposed streets with their widths and names.
         (e)   Accurate outline of any portions of the property intended to be dedicated or granted for public use.
         (f)   Names and widths of adjoining streets.
         (g)   All lots designated by numbers so as to avoid duplication; streets, avenues or other grounds designated by names, letters or numbers.
         (h)   Building setback lines, front, rear and side.
         (i)   Location of all easements provided for public use, services or utilities, with each easement labeled for its intended use.
         (j)   All dimensions and bearings necessary to locate the boundaries of the subdivision, lots, streets, clearable land area, natural resource protection areas, easements, and other areas for public or private use, including proposed green areas gifts and bridle trail easements. Linear dimensions are to be given to the nearest one one-hundredths of a foot (1/100 ).
         (k)   Radii, arcs or chords, points of tangency and central angles for all curvilinear streets and radii for rounded corners.
         (l)   Location of all required monuments and their descriptions.
         (m)   Name of the subdivision, graphic scale of the plat, north point, the names and addresses of owner of record, the subdivider and of the engineer or surveyor, and date of preparation, including the date of the latest revision.
         (n)   Private restrictions and trusteeships and their periods of existence. Should these restrictions or trusteeships be of such length so as to make their lettering on the plat impracticable and, thus necessitate the preparation of a separate instrument, reference to such instrument shall be made on the plat.
         (o)   Where private household sewage disposal systems have been approved pursuant to § 154.101 of this chapter, the developer shall place on the final plat a covenant requiring owners of said systems to maintain a perpetual service contract.
      (3)   Certifications. Certification by a registered professional civil engineer or surveyor to the effect that the plat represents a survey made by him and that all the monuments indicated thereon actually exist, and that their location, size and material are correctly shown.
   (B)   Staff review. Upon a determination of completeness as provided in § 154.022, the application for final plat approval shall be reviewed by the City Manager and the Village Engineer. If the City Manager and the Village Engineer shall find such plans and specifications to be in accordance with applicable policies and standards of the village and this chapter, the requirements of Hamilton County, and any other authority having jurisdiction, the City Manager shall determine the amount of bond, as provided in § 154.071 of this chapter. Within five working days the City Manager shall submit the plat to the Planning Commission together with a certificate showing that the construction plans and specifications and technical details have been reviewed and approved, and that the owner/subdivider has complied with the requirements of § 154.070 through 154.078.
   (C)   Planning Commission review and action.
      (1)   Upon receipt by the Planning Commission of the final plat and certificate from the City Manager, the application for final plat approval shall be placed on the Planning Commission agenda for consideration at a regularly scheduled meeting to be held within 30 working says thereof. Within 15 working days from the close of the meeting, the Commission shall act on the final plat. If the Planning Commission determines that the final plat conforms to the approved preliminary plat and that the final plat meets all requirements of this chapter, the Commission shall approve the plat with or without conditions. The Secretary of the Planning Commission shall sign the Planning Commission certificate on the plat. If the Plan Commission determines that the final plat does not conform to this chapter, then the Commission shall disapprove the plat.
      (2)   Approval of the final plat by the Commission shall not be deemed to constitute or effect an acceptance by the public of the dedication of any street or other proposed public way or space shown on the plat. Acceptance of public streets and improvements shall be pursuant to § 154.085 through 154.087.
   (D)   Recording of final plat. Upon approval of the final plat by the Planning Commission pursuant to division (C) above and upon payment by the owner/ subdivider of the fee of the Recorder of Hamilton County, plus any expenses incurred in connection therewith, the City Manager shall cause the final plat to be recorded in the office of the Recorder of Hamilton County and shall retain a copy thereof. The final plat shall be null and void if the plat is not accepted for recording within 60 days after the date of approval.
