§ 100.07 PUBLIC PROPERTY EXCAVATING.
   (A)   No person, firm, or corporation shall dig or tear up any pavement, sidewalk or crosswalk, or dig any hole, ditch, drain or sewer, in any street, alley or public property, without first obtaining a permit from the city.
   (B)   It shall be the duty of such person, firm or corporation, upon being granted a permit as herein above required to maintain all traffic control devices and to immediately refill and restore, resurface or repave such street, alley or other public property so that the same will be in as good condition as before. It shall further be the duty of such person, firm or corporation to erect sufficient barrier around any cut, trench or excavation in such manner as to prevent accidents, and to place and keep upon such barrier suitable and sufficient colored lights during the night.
   (C)   A separate permit must be obtained for each occasion and such permit shall specify the location of the cut, trench or excavation to be made.

§ 100.08 REIMBURSEMENTS.
   (A)   Sidewalk repairs may be reimbursed to a petitioning property owner for up to 50% of the cost incurred. The cost to the city shall not exceed a per lineal foot amount to be determined annually. The following conditions must be met:
      (1)   A cost estimate must be provided by the property owner before rebuild or replacement is to commence;
      (2)   City funds must be available within the city budget, and adequate replacement funding should exist for replacements so as not to compromise other prioritized sidewalks;
      (3)   Sidewalks are to be constructed to city standards; and
      (4)   The DPW Superintendent provides approval both before and after construction.
   (B)   Reimbursement shall not be made for repairs or replacements made to correct owner-caused defects such as damage by construction or vehicular traffic.

§ 100.99 PENALTY.
   Any person who violates any section of this chapter shall be deemed responsible for a civil infraction and shall pay a fine not to exceed $500. Each day a violation exists may be considered a separate violation and a fine so imposed.
