(a) There is hereby created a Fire Department of the City, which shall consist of a Fire Chief and a Fire Company staffed to meet the fire safety and emergency service needs of the City, as determined by the Fire Chief.

(b) Members of the Fire Department serving on the effective date of this section shall continue in their present status of employment in the Fire Department without examination but subject to the merit system in all other respects as provided by Article VIII of the City Charter and the ordinances adopted there under.
(c) All vacancies for the position of Fire Chief and/or members of the Fire Company existing or occurring after the effective date of this section, shall be filled in the manner provided for appointments to the administrative service of the City in accordance with the Charter and ordinances then in effect. The Fire Chief shall have command over all members of the Fire Department, and shall possess all necessary power over persons and property which shall be reasonably necessary to effectively combat any fire or other like emergency. It shall be the duty of the Fire Chief to instruct the other members of the Fire Department in the operation of the apparatus and equipment, so that members of the Fire Department are capable and efficient in the operation of the same. It shall be his duty to examine into the condition of all apparatus belonging to the Fire Department, and when any of the buildings or apparatus used for the purpose of the Fire Department requires any alterations, additions or repairs, he shall report the same to the City Manager. It shall be his duty to receive and transmit to the City Manager all communications relating to the Fire Department, to keep an exact roll of the Fire Company, to make a report to the City Manager of each fire, and to submit annually a summary of all fires and an inventory of all equipment with a statement of its condition to the Council. It shall be the duty of the Chief to be present at all fires when at all possible. He shall have the power and it shall be his duty to investigate the cause of all fires and, in connection therewith, he shall have the power to examine papers and witnesses, and compel the production and appearance of the same.
