(A) The City Council shall, by resolution, determine the days and hours of the week when, the sanitary landfill shall be open to the public for the depositing of refuse, rubbish, garbage or other material of any character.
(B) No person shall deposit refuse, garbage, rubbish or any other materials on the sanitary landfill at any other time or times.
(C) Notice of the days and hours of the week during which the sanitary landfill will be open for public use shall be posted at the sanitary landfill, and shall be published in the official city newspaper.

Every person using the sanitary landfill shall deposit refuse in areas designated and shall not deposit any refuse, garbage, rubbish or any other materials in any area posted for “no dumping” and shall only deposit refuse, garbage, rubbish or any other materials as directed by the caretakers, and in accordance with posted signs stating rules and regulations for the dumping and depositing of waste.

The following rules and regulations are to be enforced relative to the use of the sanitary landfill.
(A) Toxic and hazardous waste shall only be deposited in the area designated for toxic and hazardous waste and no toxic and hazardous waste shall be deposited unless the same has been neutralized and treated according to the Minnesota Pollution Control Agency’s Regulations and Standards for treatment of toxic anc hazardous waste.
(B) No person shall deposit or cause to be deposited on the sanitary landfill any loose paper or other loose material which can be, or is liable to be, carried by the wind outside of the sanitary landfill area.
(C) No person shall loiter on or around the sanitary landfill, pick over the refuse, garbage, rubbish or any other materials deposited there or interfere with the operation thereof.
(D) No person shall set any fire to the refuse, rubbish or garbage or any other material in the sanitary landfill or deposit any hot ashes or materials which would be liable to cause a fire to start.
(E) No person shall deposit any automobile body or parts of automobile bodies on the sanitary landfill.
(F) No person shall deposit automobile tires or other rubber tires, unless the same shall have been quartered or shredded.
(G) No tree exceeding six inches in diameter shall be deposited on the sanitary landfill unless it has been limbed and cut into lengths not exceeding three feet.
(H) No person shall discharge any firearm, air gun, bow and arrow or similar weapon on or around the sanitary landfill.
(I) No person shall tear down or damage or deface any signs posted upon the grounds by the city or its agents.
(J) No person shall dump or deposit any refuse, garbage, rubbish or other materials of any character within 200 feet of the entrance to the sanitary landfill, nor upon the roadways leading to the sanitary landfill, nor on any land adjoining the sanitary landfill.

For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
GARBAGE. Discarded material resulting from the handling, processing, storage, preparation, serving and consumption of food.
OPEN BURNING. Burning any matter whereby the resultant combustion products are emitted directly to the open atmosphere without passing through an adequate stack, duct or chimney.
PERSON. Any human being, any municipality or other governmental or political subdivision or other public agency, any public or private corporation, any partnership, firm, association or other organization; any receiver, trustee, assignee, agent or other legal representative of any of the foregoing, or any other legal entity, but does not include the Pollution Control Agency.
REFUSE. Putrescible and nonputrescible solid wastes, including garbage, rubbish, ashes, incinerator ash, incinerator residue; street cleanings and market and industrial solid wastes, and including sewage treatment wastes, which are in dry form.
RUBBISH. Nonputrescible solid wastes, including ashes, consisting of both combustible and noncombustible wastes, such as paper, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery or litter of any kind.
SOLID WASTE. Garbage, refuse and other discarded solid materials, except animal waste used as fertilizer, including solid waste materials resulting from industrial, commercial and agricultural operations, and from community activities. SOLID WASTE does not include earthen fill, boulders, rock and other materials normally handled in construction operations, solids or dissolved material in domestic sewage or other significant pollutants in water resources, such as silt, dissolved or suspended solids in industrial waste water effluents, dissolved materials in irrigation return flows or other common water pollutants.
TOXIC AND HAZARDOUS WASTES. Waste materials, including but not limited to, poisons, pesticides, herbicides, acids, caustics, pathological wastes, radioactive materials, flammable or explosive materials and similar harmful chemicals and wastes which require special handling and must be disposed of in a manner to conserve the environment and protect the public health and safety.

(A) Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
(B) Except for any provisions of §§ 51.01 through 51.07 providing for a separate penalty, any person, firm or corporation violating any provision of §§ 51.01 through 51.07 shall be guilty of a petty misdemeanor and shall be subject to a fine of not more than $100. However, in the event of a third violation within any 12 months, the violation shall constitute a misdemeanor.
(C) Any person violating any provision of §§ 51.20 through 51.26 shall be guilty of a misdemeanor, or and upon conviction thereof, shall be punished by a fine of not to exceed $100 or imprisonment in the county jail not to exceed 90 days. Each day that the violation continues to exist shall constitute a separate offense.
