A. Codes Adopted:
1. Codes Adopted Enumerated: The latest editions of the following nationally recognized codes, adopted by the state of Idaho, together with any amendments, exclusions, or revisions to the nationally recognized codes made by the state of Idaho or the Idaho building code board through the negotiated rulemaking process, are adopted as the official building codes of the city, except as provided in section 8-1-2-1 of this chapter:
International Existing Building Code, 2018 edition, with amendments, collectively named the Existing Building Code 2018 of Idaho, as adopted and amended by the Idaho Building Code Board through the negotiated rulemaking process.
International Building Code, 2018 edition, with Idaho amendments. collectively named the Building Code 2018 of Idaho, as adopted and amended by the Idaho Building Code Board through the negotiated rulemaking process.
International Energy Conservation Code, 2018 edition, with amendments, collectively named the Idaho Energy Conservation Code (2020 edition), as adopted and amended by the Idaho Building Code Board through the negotiated rulemaking process.
International Fuel Gas Code, 2018 edition, as adopted and amended by the Idaho Building Code Board through the negotiated rulemaking process.
International Mechanical Code, 2018 edition, as adopted and amended by the Idaho Building Code Board through the negotiated rulemaking process.
International Residential Code, 2018 edition (parts I, II, III, and IX), with Idaho amendments, collectively named the Idaho Residential Code (2020 edition), as adopted and amended by the Idaho Building Code Board through the negotiated rulemaking process.
National Electrical Code, 2017 edition, as prepared by the International Code Council, and as adopted and amended by the State of Idaho or by the Idaho Building Code Board, made through the negotiated rulemaking process.
Uniform Code of Abatement of Dangerous Buildings, 1997 edition.
Uniform Plumbing Code, 2017 edition, as prepared by the International Code Council, and as adopted and amended by the State of Idaho or by the Idaho Building Code Board, made through the negotiated rulemaking process.
2. Successive Versions Effective: The adopted versions of the foregoing codes shall be deemed superseded by successive versions of such codes as they are adopted or approved by the Idaho building code board effective January 1 of the year following the adoption by the Idaho building code board. B. Exemption Of Agricultural Buildings: A building that meets the definition of "agricultural building" contained herein shall be exempt from the requirements of the building codes adopted herein, provided that the building is used solely as an agricultural building and the property on which the building is sited has been determined by the Kootenai County assessor to be land actively devoted to agriculture.
1. Definitions:
AGRICULTURAL BUILDING: A structure that is designed and constructed for one or more of the following purposes:
a. Livestock shelters or buildings including shade structures and milking barns;
b. Poultry buildings or shelters;
c. Barns;
d. Storage of equipment and machinery used exclusively in agriculture;
e. Horticultural structures, including detached production greenhouses and crop protection shelters;
f. Sheds;
g. Grain silos; or
h. Stables.
EQUIPMENT AND MACHINERY USED EXCLUSIVELY IN AGRICULTURE: Farm implements and other equipment and machinery that are used exclusively on land actively devoted to agriculture and are not used on public highways except as necessary for access to land actively devoted to agriculture.
LAND ACTIVELY DEVOTED TO AGRICULTURE: Real property meeting the eligibility criteria for appraisal, assessment and taxation as agricultural property as set forth in Idaho Code 63-604.
The above definitions shall supersede any definitions of these terms that are contained in the international building code.
2. Requirements Applicable To Agricultural Buildings: Notwithstanding any other provisions of this chapter, the following requirements shall apply to agricultural buildings:
a. An agricultural building shall not be:
(1) Used as a place of human habitation; or
(2) Used as a place of employment where agricultural products are processed, treated or packaged; or
(3) Open to use by the public.
3. Placement Standards: All agricultural buildings shall conform to the minimum placement standards established pursuant to the Harrison zoning ordinance.
4. Site Permit: The owner of an agricultural building shall obtain a site permit for the building from the Harrison building department. (Ord. 427, 6-2-2009; amd. Ord. 453, 2-4-2014; Ord. 2023-488, 10-26-2023)
