§ 96.999 PENALTY.
   (A)   (1)   Any person, agent, corporation or other entity who violates, neglects or refuses to comply with any provision of §§ 96.004 through 96.012 is responsible for a municipal civil infraction for the first and second offense of the same provision within a period of 365 days. The City Council shall establish a fine structure for a first and second offense municipal civil infraction.
      (2)   Any person, agent, corporation or other entity who violates, neglects or refuses to comply with any provision of §§ 96.004 through 96.012 is responsible for a misdemeanor for the third and any subsequent offense of the same provision within a period of 365 days. Upon conviction, the person, agent, corporation, or other entity may be fined up to $500, sentenced to 90 days in jail, community service for a time determined by the judge, or any combination of the above.
      (3)   In addition to any other penalty or sanction provided in §§ 96.004 through 96.012, the court may require the defendant to pay any unpaid fees and charges arising from the provisions of §§ 96.001 through 96.015 .
      (4)   Each day that a violation of §§ 96.004 through 96.012 exists shall be deemed to be a separate offense.

      (2)   Any person, agent, corporation or other entity who violates, neglects or refuses to comply with any provision of §§ 96.027 through 96.030 is responsible for a misdemeanor for the third and any subsequent offense of the same provision within a period of 365 days.
