977.08 RENTAL POLICY, FEES AND CHARGES FOR USAGE OF RIVERSEDGE.
   (a)    Fees for the use of RiversEdge are hereby established and shall be as follows.
      (1)    Public concert or performing arts event with no alcohol sales.
         A.    A four-hour minimum rental is $750. Two hours of the four-hour minimum rental shall be dedicated to one--hour of set-up before the event and one-hour of clean-up after the event. Sound check or private stage set up is not included in the four-hour rental and the renting party will not be charged the additional hourly rate.
         B.    Each additional hour is $190.
         C.    A Security deposit of $500 is required.
         D.    There is a $100 fee per vendor space (4 vendor spaces available) if vendor requires use of electricity.
         E.    The rental fee includes the following personnel and services: minimum of two (2) off-duty City of Hamilton police officers for security, four (4) parks employees for set-up, clean-up, trash collection and disposal, and other miscellaneous services; one (1) facility caretaker to open pavilion, turn on electricity, open restrooms and stock restroom supplies.
      (2)    Public event with no concert or performing arts and no alcohol sales.
         A.    A four-hour minimum rental is $350. Two hours of the four-hour minimum rental shall be dedicated to one-hour of set-up before the event and one-hour of clean-up after the event. Sound check or private stage set up is not included in the four-hour rental and the renting party will not be charged the additional hourly rate.
         B.    Each additional hour is $90.
         C.    A Security deposit of $250 is required.
         D.    There is a $100 fee per vendor space (4 vendor spaces available) if vendor requires use of electricity.
         E.    The rental fee includes the following personnel and services: two (2) parks employees for set-up, clean-up, trash collection and disposal, and other miscellaneous services; one (1) facility caretaker to open pavilion, turn on electricity, open restrooms and stock restroom supplies.
      (3)    Public concert or performing arts event with the sale of alcohol
         A.    A four-hour minimum rental is $890. Two hours of the four-hour minimum rental shall be dedicated to one-hour of set-up before the event and one-hour of clean-up after the event. Sound check or private stage set up is not included in the four-hour rental and will not be charged the additional hourly rate.
         B.    Each additional hour is $220.
         C.    A Security deposit of $620 is required.
         D.    There is a $100 fee per vendor space (4 vendor spaces available) if vendor requires use of electricity.
         E.    The rental fee includes the following personnel and services: minimum of three (3) off-duty City of Hamilton police officers for security, four (4) parks employees for set-up, clean-up, trash collection and disposal, and other miscellaneous services; one (1) facility caretaker to open pavilion, turn on electricity, open restrooms and stock restroom supplies.
         F.    All renters wishing to serve alcohol must obtain their own liquor permit and provide a licensed bartender.
      (4)    Private event (pavilion only) with no performing arts or concert
         A.    A four-hour minimum rental is $300.
         B.    Each additional is hour $75.
         C.    A Security deposit of$100 is required.
         D.    The Rental fee includes the following personnel and services: one (1) facility caretaker to open pavilion, turn on electricity, open restrooms and stock restroom supplies.
   (b)    In addition to the above fees, a custodial charge in the amount of $35/hour shall be incurred at the sole expense of the renter in the event the above facility is not left in good condition and extra services are required in order to repair the facility to the same condition as when the facility was originally used by any person or organization. Renters shall be subject to custodial fees for custodial services including, but not limited to, cleaning of stains on concrete, turf repair, and damaged picnic tables. If there are any structural damages to the pavilion building, its premises or concrete surfaces, or stage roof and/or roof supports; the renter will be billed for any expense incurred by the city in repairing the damage.
   (c)    The City Manager or his designee may, but is not required to, modify or waive the fees set forth in Section 977.08 (a)(1), (2), (3) and (4) under the following conditions and as the City Manager or his designee determines to be necessary:
      (1)    The organization or sponsor for the event is a non-profit organization exempt under Section 501 (c)(3) of the Internal Revenue Code;
      (2)    If the payment of overtime is not required for any City employees for any purpose related to said recreational facilities; and
      (3)    If the City Manager or his designee deems a modification or waiver is appropriate taking into consideration the benefit to the public and/or the purpose of the event for which the recreational facility is to be used.
   (d)    RiversEdge Rental Procedure. All prospective renters of RiversEdge Amphitheater shall adhere to the following procedures when renting the facility.
      (1)    All rental applications shall be obtained from and filed with the Department of Resident Services no later than 45 days prior to the event.
      (2)    All renters must obtain an assembly permit in accordance with Section 315.03 of the Codified Ordinances of the City of Hamilton, Ohio.
      (3)    Within 10 days of filing a rental application, all prospective renters shall be required to attend a pre-rental meeting with the Director of Resident Services or his designee and a representative from other applicable City departments.
      (4)    The City of Hamilton, Ohio reserves the right to deny any rental request based on the nature of the event.
      (5)    All prospective renters of the facility are required to obtain and present proof of a $2 million general liability insurance policy naming the City of Hamilton as an additional insured with indemnification against any claims, demands, suits or judgments arising out of the use privilege. Additionally, all prospective renters wishing to serve alcohol at the facility must also obtain and present proof of a $2 million DRAM shop insurance policy naming the City of Hamilton as an additional insured with indemnification against any claims, demands, suits or judgments arising out of the use privilege.
      (6)    Upon completion of above items (d)(1-5), renter will enter into a license agreement with the City of Hamilton, Ohio.
   (e)    Cancellation of event and refund of Security Deposit. The renting party shall provide notice of cancellation of an event 30 days prior to the event. In the event that 30 days cancellation notice is not provided; the renting party will forfeit half of the security deposit.
