315.03 SPEcIAL EVENT PERMIT APPLICATION.
   It shall be unlawful for any person to hold any parade, demonstration, block party, rally, recreational assembly, or special event without the issuance of a special event permit.
   (a)    Permit for Parade, Demonstration, Block Party, Rally, Recreational Assembly or Special Event. A person seeking issuance of a special event permit for a parade, demonstration, block party, rally recreational assembly or special event shall file an application with the Chief of Police on forms prescribed by the City Manager.
   (b)    Filing Period for Parade, Demonstration, Block Party, Rally, Recreational Assembly or Special Event. An application for a parade, demonstration or rally permit shall be filed with the Chief of Police not less than fourteen (14) days or not more than ninety (90) days and no closer than twenty-one (21) days before the date on which it is proposed to conduct the parade, demonstration or rally. The City Manager may waive the establihed minimum application period and accept an application filed within a shorter period if, after due consideration of the date, time, place and nature of the event or special event, the anticipated number of participants, and the municipal services required in connection with the event or special event, the City Manager determines that the waiver will not present a public safety hazard.
   (c)    Recurring Parades or Recreational Assemblies or Recurring Special Events. For events or special events held on a regular or recurring basis at the same location, an application for a permit covering all such events during the calendar year may be filed with the Chief of Police at least ninety (90) and not more than one hundred eighty (180) days before the date and time at which the first such event or special event is proposed to commence. The City Manager may waive the minimum ninety (90) day period after due consideration of the factors specified in subsection (b) above.
   (d)    Contents. The application for a special event permit shall set forth the following information:
      (1)    The name, address, and telephone number of the person seeking to conduct the event or special event;
      (2)    If the event or special event is proposed to be conducted for, on behalf of, or by an organization, and of the authorized and responsible heads of such organization;
      (3)    The name, address and telephone number of the person who will be the chairman and who will be responsible for its conduct.
      (4)    The date when the event or special event is to be conducted;
      (5)    The area to be affected by the event or special event; if a parade or walking demonstration the beginning and ending point;
      (6)    The approximate number of persons who will participate and animals if any, and the description of any vehicles;
      (7)    The hours when such event or special event will start and terminate;
      (8)    A statement as to whether the event or special event will occupy all or only a portion of the width of the streets, sidewalk, park or other public place proposed to be used;
      (9)    The location by street of any assembly area for such event or special event;
      (10)    The time at which units of the event or special event will begin to assemble at such assembly area or areas;
      (11)   If the event is designed to be held by, and on behalf of or for, any person other than the applicant, the applicant for such permit shall file with the Chief of Police a communication in writing from such person authorizing the applicant to apply for the permit on his or her behalf;
      (12)    Any additional information, such as whether the event is a parade or a recreational assembly or a special event, which the Chief of Police shall find reasonably necessary to a fair determination as to whether a permit should be issued.
   (e)    Special Event Permit Application Fee. The City may charge a fee or require a deposit for the issuance of a special event permit. The fees and deposits may vary or be waived based upon the type of event and the services needed for the event and are in addition to any expenses or fees that may be required for police protection as determined in Section 315.04 of this Chapter. The City Manager shall set the special event permit fees, and shall cause a list of fees to be listed on the City of Hamilton's website and provide the list of fees to Hamilton City Council as fees are updated.
