735.99 PENALTY.

   (a)   Whoever violates Section 735.02 shall be guilty of a first degree misdemeanor and shall be punished as defined in Section 501.99 of the General Offenses Code.

   (b)   Whoever violates Section 735.08, 735.09 or 735.10 shall be guilty of a third degree misdemeanor for the first offense and shall be guilty of a first degree misdemeanor for subsequent violations occurring within five years and shall be punished as defined in Section 501.99 of the General Offenses Code. In addition to any other penalty permitted by law, if an offender is convicted of a first degree misdemeanor as provided in this subsection, the court shall impose a suspension of the swap shop/second-hand dealer’s license for a period of not less than sixty nor more than one hundred eighty days.

   (c)   Whoever violates Section 735.04, 735.05 or 735.051 shall be guilty of a fourth degree misdemeanor and shall be punished as defined in Section 501.99 of the General Offenses Code.

   (d)   A separate offense shall be deemed committed upon each day during or on which the violation occurs or continues.
