9.32.040 Violation--penalty.

   A.   Any person violating the provisions of sections 9.32.020 or 9.32.030 shall be guilty of an infraction and upon conviction thereof shall be fined not less than fifty dollars ($50) nor more than two hundred and fifty dollars ($250) for a first offense.

   B.   Any person convicted of a second or subsequent violation of this chapter may be cited as an infraction or may be charged with a misdemeanor. Upon a second or subsequent conviction of this chapter, a person found guilty thereof may be fined in an amount not less than one hundred dollars ($100) nor more than five hundred dollars ($500) in addition to any other penalty authorized by law.
