6-2-9: BURNING GARBAGE; LITTERING; DEFACING CONTAINERS; AND UNAUTHORIZED DEPOSITS OF GARBAGE PROHIBITED:
   (A)   It shall be unlawful for any person to burn "garbage", refuse, or trash as defined in this chapter, or to burn dead animals or parts thereof, tires or rubber materials or products, junk motor vehicles or any materials resulting from a salvage operation, plastics, asphalt or composition roofing or any other asphalted material or products, tar, tarpaper, waste, or heavy petroleum products or paints, lumber or timbers treated with preservatives, including railroad ties, trade waste (commercial, industrial or construction waste), insulated wire, pathogenic waste, or hazardous waste within the city limits, or to allow the same to be spilled, strewn or scattered on the streets of the city or upon public or private property, or placed in garbage containers. Garbage, refuse, trash or other debris of a nature that is forbidden to be burned or placed in garbage containers, shall be transported and deposited by the owner or occupant of the premises on which the same is located in a sanitary landfill authorized by the state or county for said purposes. This section shall not apply to the burning of weeds, grass or brush which originate on the property on which it is burned. (Ord. 269, 5-1-2007)
   (B)   It shall be unlawful for any person to deface, damage, or destroy any authorized garbage container of the city.
   (C)   It shall be unlawful for any person to deposit any garbage, refuse, rubbish, trash or other debris in any garbage container which has been issued to a third person, or purchased by said third person, and each person shall deposit his garbage, refuse, rubbish, trash or other debris only in those containers which have been issued to that person or purchased by that person. If any person violates this particular provision as to unlawful deposit of garbage or other debris he shall be subject to a fine payable to the city clerk in the sum of fifteen dollars ($15.00), upon written notification by the city clerk to said person of said unlawful deposit of garbage or other debris in an unauthorized container. If said person fails to pay the fifteen dollar ($15.00) fine to the city within ten (10) days after mailing of said notification, then the city shall cause a citation to be issued for violation of this provision, and said person shall be punished in accordance with section 6-2-10 of this chapter and shall pay the fines and be subject to the penalties as provided therein, and in section 1-4-1 of this code.
