§ 34-29 PENALTY.
   (a)   (1)   The cutting, topping or destruction of any priority tree without a tree permit shall:
         A.   Result in a fine as set forth in the village’s Comprehensive Fee and Fine Schedule for each priority tree cut, topped or destroyed; and
         B.   Require immediate compliance with this article, including without limitation application for and issuance of a tree permit pursuant to §§ 34-23 through 34-25 of this code and installation of replacement trees or payment of the tree replacement fee pursuant to § 34-26 of this code.
      (2)   The cutting, topping or destruction of each priority tree shall be a separate violation, and each day that such violation continues and compliance with this article has not been met shall be a separate violation.

   (b)   Any other violation of this article shall result in a fine as set forth in the village’s Comprehensive Fee and Fine Schedule for each offense. Each day that a condition continues in violation of the provisions of this article shall be deemed a separate offense.

   (c)   In the event that any person undertakes any cutting or destruction of a priority tree without a permit due to emergency circumstances, the village arborist shall have the authority to waive any penalty or to issue a tree permit after the fact of such cutting or destruction.
