§ 23-114 POST-TOW NOTICE FOR HAZARDOUS AND UNLAWFUL VEHICLES.
   (a)   Not more than seven days after towing any hazardous or unlawful vehicle pursuant to § 23-111(b) of this article, the village shall forward written notice of the towing by certified or registered mail, return receipt requested, to the address of the owner of the vehicle as indicated in the most current registration list of the Secretary of State of the state in which such vehicle is registered. The notice shall be in the forms provided in subsections 23-114(c) and 23-114(d) of this article.
   (b)   All approved towing service operators shall prominently post two large signs, with dimensions of at least 12 inches by 18 inches, indicating the opportunity and procedures for a hearing to contest the validity of any vehicle tow. These signs, the form for which is set out in subsection 23-114(c) of this article, shall be placed in locations readily visible to the public transacting business at any towing facility.
   (c)   The following form shall be utilized for the purpose of giving post-tow notice to owners pursuant to subsections 23-114(a) and 23-114(b) of this article by posting in towing establishments and mailing to owners:
NOTICE OF VEHICLE RELEASE REQUIREMENTS AND HEARING RIGHTS
   BEFORE THE OWNER OF ANY IMPOUNDED VEHICLE SHALL BE PERMITTED TO REMOVE THE SAME FROM CUSTODY OF THE GLENCOE DEPARTMENT OF PUBLIC SAFETY OR ITS AUTHORIZED TOWING SERVICE OPERATOR, SUCH OWNER SHALL FURNISH EVIDENCE OF HIS OR HER IDENTITY AND OWNERSHIP OF THE VEHICLE AND RIGHT OF POSSESSION THERETO, SHALL SIGN A RECEIPT FOR THE VILLAGE, AND SHALL PAY A FEE OF $_______ FOR A PASSENGER VEHICLE OF NOT MORE THAN 7 PASSENGERS, AND $_______ FOR ANY OTHER VEHICLE TO COVER THE COST OF TOWING OR REMOVAL TO A VEHICLE POUND OR AUTHORIZED GARAGE, AND IN ADDITION THEREOF, THE COST OF STORAGE OF $_______ PER DAY FOR A PASSENGER VEHICLE OF NOT MORE THAN 7 PASSENGERS, AND $_________ PER DAY FOR ANY OTHER VEHICLE.
   FAILURE TO CLAIM A TOWED VEHICLE WILL RESULT IN ITS SALE AT PUBLIC AUCTION PURSUANT TO THE PROVISIONS OF THE GLENCOE VILLAGE CODE.
   ANY OWNER WISHING TO CONTEST THE VALIDITY OF THE TOW MAY OBTAIN A HEARING UNDER THE CONDITIONS OF EITHER PARAGRAPH (A) OR (B) BELOW:
TO OBTAIN A HEARING
   (A)   IF THE VEHICLE HAS BEEN RELEASED, THE OWNER MAY, WITHIN 15 DAYS OF THE RELEASE OF THE VEHICLE OR THE MAILING OF THE NOTIFICATION OF THE TOW, WHICHEVER OCCURS FIRST, REQUEST A HEARING BY DELIVERING A REQUEST FOR HEARING IN WRITING TO THE GLENCOE DEPARTMENT OF PUBLIC SAFETY, 675 VILLAGE COURT, GLENCOE, ILLINOIS 60022. THE RIGHT TO ANY HEARING SHALL BE DEEMED WAIVED AFTER SUCH 15 DAY PERIOD.
   (B)   IF THE VEHICLE IS STILL IMPOUNDED, THE OWNER SUBMIT A WRITTEN REQUEST TO THE ABOVE OFFICE AND OBTAIN A HEARING WITHIN 24 HOURS AFTER THE REQUEST, EXCLUDING WEEKENDS AND HOLIDAYS, UNLESS THE REQUEST IS MADE AFTER 3:00 P.M. IF A REQUEST FOR A HEARING IS MADE AFTER 3:00 P.M., THE HEARING WILL TAKE PLACE ON THE SECOND WORKING DAY THEREAFTER, EXCLUDING WEEKENDS AND HOLIDAYS.
NATURE OF HEARING
THE HEARING SHALL BE CONDUCTED ACCORDING TO VILLAGE ORDINANCE PROVISIONS AND SHALL DETERMINE THE VALIDITY OF THE TOWING AND IMPOUNDING OF THE VEHICLE AND THE IMPOSITION OR REFUND OF ANY TOWING OR STORAGE CHARGES, BUT THE HEARING WILL NOT DETERMINE OR ADJUDICATE ANY CITATIONS ISSUED. IF THE HEARING OFFICER SUSTAINS THE VALIDITY OF THE TOW AND IMPOUNDING, THE OWNER SHALL PAY ALL UNPAID TOWING AND STORAGE FEES BEFORE OBTAINING THE RELEASE OF THE VEHICLE.
 
   (d)   The following form, along with the form in subsection 23-114(c) of this article, shall be utilized for the purpose of giving post-tow notice to owners pursuant to subsection 23-114(a) of this article:
