§ 23-45.1 PROTECTIVE HELMETS.
   (a)   Helmet required. Every person under the age of 16 years, whenever riding or being carried on or upon any bicycle, carrier attached to or pulled by a bicycle, skateboard, roller or inline skates, or non-motorized scooter on a public street, sidewalk, bicycle path or other public right-of-way in the village, shall wear a protective helmet that meets the standards promulgated by the American National Standards Institute, the American Society for Testing and Materials or the Snell Memorial Foundation.
   (b)   Violation; penalties. Every person who is found to have violated the provisions of this section shall be subject to the following penalties.
      (1)   First violation. A notice shall be sent to the parents or legal guardians of the violator regarding the violation.
      (2)   Second violation. The violator shall either:
         A.   Be required to attend an educational program provided by the department of public safety on public safety-related subjects including the use of protective helmets; or
         B.   If the violator fails to attend the educational program as provided in subsection 23-45.1(b)(2)A. of this section, be subject to a fine as set forth in the village’s Comprehensive Fee and Fine Schedule.
      (3)   Third violation. The violator shall either:
         A.   Be required to complete, to the satisfaction of the department of public safety, ten hours of community service in the village within a time period to be prescribed by the department of public safety; or
         B.   If the violator fails to provide the community service as directed by the department of public safety and within the time period prescribed therefor as provided in subsection 23-45.1(b)(2)A. of this section, be subject to a fine as set forth in the village’s Comprehensive Fee and Fine Schedule.
      (4)   Fourth and subsequent violations. The violator shall either:
         A.   Be required to complete, to the satisfaction of the department of public safety, 20 hours of community service in the village within a time period to be prescribed by the department of public safety; or
         B.   If the violator fails to provide the community service as directed within the time period prescribed, shall be subject to a fine as set forth in the village’s Comprehensive Fee and Fine Schedule.
