(a) No person shall establish or maintain any vending machine without having been licensed to do so. Every person establishing or maintaining any such vending machine shall annually pay a license fee as set forth in the village’s Comprehensive Fee and Fine Schedule.
(b) Licenses for the operation of vending machines subject to the provisions of article V, division 3 of chapter 21 of the village code shall be issued in accordance with the procedures established therein. Licenses for the operation of all other vending machines shall be issued in accordance with licensing procedures, including regular inspections, to be established by the village manager as necessary to protect the public health, safety and general welfare.
(c) The term VENDING MACHINE shall mean any self-service device offered for public use which, upon insertion of a coin, coins or token, or by any other means, dispenses any product for human consumption, either in bulk or in package, without the necessity of replenishing the device between each vending operation. For purposes of this section, ice shall be deemed to be a product for human consumption. The term VENDING MACHINE shall not include machines which dispense cigarettes or other tobacco products; each such machine shall be subject to the license and fee provisions of chapter 33 of the code.
