While performing the necessary work on private properties referred to in § 21A-45, the director of public works or duly authorized representatives of the village, the Illinois Environmental Protection Agency or the United States Environmental Protection Agency shall observe all safety rules applicable to the premises established by the owner of such premises and the owner shall be held harmless for injury or death to the director or such representatives and the village shall indemnify the company against liability claims and demands for personal injury or property damage asserted against the owner and growing out of the gauging and sampling operating, except as such may be caused by negligence or failure of owner to maintain conditions as required in division 4.
