§ 9-74 DEFINITIONS.
   (a)   The terms used in this chapter shall have the definitions or meanings that such terms have in the zoning ordinance.

   (b)   Notwithstanding subsection 9-74(a) hereof, any dedicated but unimproved street or right-of-way shall not be deemed a street for purposes of regulating a fence if the owner of such fence has executed, recorded against the affected property, and delivered to the village a declaration of covenants in a form acceptable to the village that requires the owner to remove any nonconforming fence immediately upon the improvement of such street or right-of-way.
