§ 6-42 PROCEDURE FOR OBSERVATION.
   (a)   The owner of an animal involved in a biting incident, upon receiving notice of such fact in any manner, shall confine the biting animal under observation of a licensed veterinarian for a period of ten days beginning within 24 hours of the biting incident. The biting animal may be confined on the premises of its owner in a manner that will prohibit it from biting any person or animal if a licensed veterinarian adjudges such confinement satisfactory.
      (1)   When the biting animal is currently inoculated with rabies vaccine the animal's health shall be reported by the veterinarian to the director of public safety on the first and tenth day of observation.
      (2)   When the biting animal is not currently inoculated with rabies vaccine the animal's health shall be reported by the veterinarian to the director of public safety on the first, fifth and tenth days of observation.
   (b)   If it is determined by the examining veterinarian that the confined animal has rabies the director of public safety shall order the animal humanely destroyed.
   (c)   If it is determined that the confined animal is not infected with rabies then at the end of the period of confinement it shall be released to the owner of such animal upon proof of a current rabies inoculation certificate and license tag and upon payment of any fees and charges, including any fee for veterinary services. If the animal is not claimed by the owner the animal may be disposed of in accordance with the provisions of Ill. Rev. Stat. 1975, ch. 8, par. 361.
