No occupant or owner of any premises to which water and/or natural gas is supplied is allowed to supply, or shall supply to any person or families, any service from the city water and/or natural gas system, or permit the same to be taken except upon special permit from the City Council. Any consumer violating this provision will be charged the additional amount that such user or users would be charged if the water and/or natural gas service was billed to the user or users by the city. This amount is to be collected in the same manner and at the same rate as other water and natural gas service.

The city hereby establishes a surcharge of $25 payable by each customer of its system who receives or benefits from the services of the project financed by the CW-05 loan with the borrower bond. The collection of the surcharge shall start on April 1, 2024. The surcharge shall remain in effect until such time as the borrower bond is paid in full, it shall be collected at the same time as other charges of the system and establish a surcharge account to segregate the income from other system income for bookkeeping purposes to be pledged to the South Dakota Conservancy District. The surcharge shall be reviewed from year to year and modified in order to provide the required 110% debt coverage.

The surcharge shall remain in effect until such time as the borrower bond is paid in full, it shall be collected at the same time as other charges of the system and establish a surcharge account to segregate the income from other system income for bookkeeping purposes to be pledged to the South Dakota Conservancy District. Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $500, or by imprisonment not to exceed 30 days, or by both such fine and imprisonment. In addition, if such violations is of any provision involving a license, the City Council may permanently revoke the license of any licensee so convicted after notice and opportunity for healing.
