139.05 ARCHITECT'S ADDITIONAL SERVICES.
   (a)   For Architect’s services, other than listed in 139.04, additional compensation shall be provided by the City based upon the following schedule:
      (1)   Studies, plan examination or special reports shall be based upon an hourly rate schedule in (3) below.
      (2)   Services in connection with construction projects shall be based upon the schedule of fees listed in (b) below. (Ord. 03-2001. Passed 1-22-01.)

Payment shall be made under this subsection (3) upon the completion of each service and upon billing by the Architect setting forth the time spent by the Architect and his employees along with expenses, supplies and transportation furnished.

      (2)   Remodeling, additions and mixed building types: For remodeling work add fifty percent (50%) to the cost of services for the first five hundred thousand dollars ($500,000) of construction cost, and twenty-five percent (25%) to the cost of service for that portion of the construction cost in excess of five hundred thousand dollars ($500,000). When projects include both new construction and remodeling, the rate shall be determined on the basis of each portion.
   (c)   Where compensation is based on a percentage of construction cost, payments for basic service shall be made, so that basic compensation for each phase shall equal the following percentages of the total basic compensation fee. Each phase is payable upon invoice documentation.

   (d)   Cost of Construction Definition.
      (1)   The construction cost shall be the total cost or estimated cost to the owner of all elements of the project designed or specified by the Architect.
The construction cost shall include at current market rate, including a reasonable allowance for overhead and profit, the cost of labor and materials furnished by the owner and any equipment which has been designed, specified, selected or specially provided for by the Architect.
      (2)   Construction cost does not include the compensation of the Architect and the Architect's consultants, the cost of the land, rights-of-way or other costs which are the responsibility of the owner.
   (e)   The fees provided in subsection (c) above shall cover architectural services as described for each phase. The services do not include property, boundary, topographical or right-of-way surveys; test borings and/or other subsurface explorations; calculation of assessments or environmental impact statements; laboratory services including soils analysis.
   (f)   Reimbursable Expenses.
      (1)   Reimbursable expenses are in addition to the compensation for basic and additional services and include actual expenditures made by the Architect and the Architect's employees and consultants in the interest of the project for the expenses listed in the following paragraphs:
      (2)   Expense of transportation in connection with the project; living expenses in connection with out-of-town travel; long distance communication; and fees for securing approval of authorities having jurisdiction over the project.
      (3)   Expense of reproductions, postage and handling of drawings, specifications and other documents, excluding reproductions for the office use of the Architect and the Architect's consultants.
      (4)   Expense of data processing and photographic production techniques when used in connection with additional services.
      (5)   Expense of renderings, models and mock-ups requested by the City.
