128.02 APPOINTMENT BY CHIEF OF POLICE.
   (a)   The members shall be appointed by the Chief of Police, and shall serve at his pleasure and discretion, and upon whatever qualifications he may determine. The Chief of Police shall designate duties to be performed by such members, who shall serve at such time and such place under the instructions of the Chief of Police.
   (b)   Auxiliary police officers shall not be on the classified list of the Division of Police, nor eligible for participation in the Police Disability and Pension Fund under Ohio R.C Chapter 742.
   (c)   Auxiliary police officers shall be classified into two levels, as follows:
      (1)   Level I. Officers who have completed the course of study designated by the Ohio Peace Officers Training Council for peace officers, under Ohio R.C. 109.77 (or Rule 109: 2-1-16 of the Ohio Administrative Code), shall have the powers and exercise all the duties provided by law for police officers in preserving the peace, protecting persons and property and obeying and enforcing all ordinances and resolutions of the City and all criminal laws of the State, while on actual duty or when called upon to supplement the regular police.
      (2)   Level II. Officers who have not completed the course of study designated by the Ohio Peace Officers Training Council for peace officers, under Ohio R.C. 109.77 (or Rule 109: 2-1-16 of the Ohio Administrative Code), shall act as parapolice and shall exercise only those duties assigned and/or designated to them by the Chief of Police.
   (d)   All auxiliary police officers shall further be governed by the rules and regulations pertaining to them which are adopted by the Chief of Police and the Director of Safety, and shall be further bound by any directives or orders of the Chief of Police pertaining to their operation and conduct.
