SECTION 35. VACANCY IN THE OFFICE OF MAYOR.
   When the Mayor is absent and inaccessible, or is unable for any cause to perform his duties, the President of Council shall be Acting Mayor. In case of death, resignation or removal of the Mayor, or the Mayor ceasing to qualify for the office, the President of Council shall vacate his office and succeed to the office of the Mayor. In the event the President of Council is for any reason unable to succeed to the office of the Mayor, then the Council President Pro Tem shall vacate his office and succeed to the office of Mayor. In the event that neither the President of Council nor the Council President Pro Tem is able to succeed to the office of Mayor, then a new Mayor shall be selected by the Council of the City from its qualifying membership by a majority vote. In the event that the Mayor shall be unable to complete his term of office and there remains more than one (1) year remaining in the Mayor’s term of office, then a special election shall be called. The special election shall be governed under the rules for special election in effect in the Municipality at the time the Mayor vacates office, and shall be held ninety (90) days from the day the Mayor vacates office. If the 90th day falls on a Saturday, Sunday or federal holiday, then the election shall be held on the first Tuesday following the Saturday, Sunday or federal holiday. (Amended 11-3-98.)
