1369.03 REGULATION OF FAMILY HOMES.
   The City Planning Commission, with the confirmation of Council, may permit a family home in a U-1 Zoning District, provided the Commission finds the following conditions have been met:
   (a)   Such home shall conform to all applicable City and State Building Code requirements prior to occupancy.
   (b)   Such home shall contain smoke detectors in locations as prescribed by the Fire Chief and shall observe and contain such other fire prevention measures as may be approved by the Fire Chief pursuant to the City Fire Prevention Code. In any case where a difference may exist between the requirements of the City Fire Prevention Code and any other applicable County, State or federal laws and regulations, the more restrictive shall govern.
   (c)   The applicant has demonstrated that adequate funding will exist for maintenance of the property and for Building Code compliance. The City may, where warranted, require a performance bond for maintenance of the property and for Buildinmg Code compliance and establish the amounts thereof.
   (d)   The applicant has demonstrated that adequate qualified supervision will exist in the home; supervision would be on a twenty-four hour basis.
   (e)   No additional off-street parking shall be allowed.
   (f)   A two-family dwelling wherein a family home is located shall not contain a third floor which is rented or occupied separately from the first or second floor dwelling units.
   (g)   Each existing bedroom in a family home shall provide for no more than two persons, and each bedroom shall contain a minimum of 100 square feet of habitable floor area for the first person and one hundred forty square feet for two persons.
   (h)   Any dwelling which is the subject of an application for a family home shall be made available for inspection by the Commission prior to approval of the proposed use by the Commission; and be in compliance before occupancy.
   (i)   Signs or other means of identification as a family home shall not be permitted.
   (j)   Such home may not be located within one-half mile of an additional family home.
