1369.02 ADMISSIONS.
   (a)   Such home is for the purpose of serving the following categories of persons:
      (1)   Developmentally disabled.
      (2)   Mentally retarded.
      (3)   Physically handicapped.
   (b)   Such home is used by, exclusive of supervisory personnel, not less than two and not more than eight persons per dwelling unit. The actual limit for each home should carefully fit the nature of the persons served, location, supervision and facility.
   (c)   Freedom to exit the dwelling by persons using such home is not physically restricted.
   (d)   Each individual, group or agency operating a family home as provided in this chapter shall have a comprehensive written admissions policy which includes the following requirements:
      (1)   Pre-admissions screening procedures which include at least the following:
         A.   Pre-placement interview of each prospective resident of such home by a staff member.
         B.   Pre-placement visit by each prospective resident to such home.
         C.   Pre-placement written agreements from all necessary agencies to provide those services to the prospective resident which are required under the prospective resident's treatment plan.
         D.   City residents to have first priority if of equal qualifications.
         E.   The prospective resident shall be enrolled in day programs outside the community or employed in the community.
      (2)   Written assurances from the referring agency, prior to transfer of each prospective resident, that each prospective resident can function adequately in a community setting and that such person shall not constitute a reasonably foreseeable danger to the community.
   (e)   Such home has provided assurances that persons in the following categories shall not be admitted as residents:
      (1)   Persons discharged within the last ten years from a penal or correctional facility, or from the custody of the Ohio Department of Youth Services.
      (2)   Persons under probation, parole or conditional release during the time of residence.
      (3)   Persons discharged from any facility after being found incompetent to stand trial or not guilty by reason of insanity.
      (4)   Persons being treated for drug or alcohol abuse.
      (5)   Persons who cannot function adequately in a community setting and/or who constitute a reasonably foreseeable danger to the community.
      (6)   Persons who have not completed all pre-admission requirements as set forth in subsection (d)(1) hereof.
