1351.26 MOVING OUTSIDE THE CITY; APPEALS.
   (a)   No building or structure shall be moved from any location in the City to any location outside the City unless the Board of Review shall first make a finding in writing based upon substantial, reliable and probative evidence that it would be injurious to the public health, welfare or safety of the City to permit such building or structure to be relocated anywhere in the City.
 
   (b)   The Board shall act upon each application for a permit no later than fifteen days after such application shall be filed pursuant to the provisions of Section 1351.03. If the Board shall refuse or fail to issue a permit, the applicant shall have the right to appeal such failure or refusal to the Board of Zoning Appeals by filing in written notice of appeal with the Secretary of the Board of Zoning Appeals within thirty days after such application shall be denied. The Board of Zoning Appeals shall have the power to hear and decide such appeals in the same manner that it hears and decides all other appeals, all in accordance with the rules and regulations established by the Board of Zoning Appeals. If the Board of Zoning Appeals shall fail to grant such application upon appeal, the applicant shall then have the right of appeal as provided in Ohio R.C. Chapter 2506.
